DISCUSSION
In 2003, the South Coast Air Quality Management District (SCAQMD) mandated performance standards for Enhanced Vapor Recovery at gasoline dispensing facilities.
SCAQMD requires compliance measures to be strictly in place at all times. The Department of Public Works, Fleet Services Bureau faces the challenge of maintaining all Underground Storage Tanks and bringing them into compliance with Title 23 of the California Code of Regulations. By January 1,2009, the City will be required to complete the Enhanced Vapor Recovery Phase II project.

In 2003, Wayne Perry, Inc., was contracted to upgrade, repair and re-pipe fuel sites with enhanced vapor systems mandated by the SCAQMD. Their contractual agreement was renewed through September 1, 2006.

In August 2006, the vendor began the repairs to Fire Station No. 16 fuel site located at 2840 Wardlow Road prior to the expiration of their contractual agreement. The repairs were expected not to exceed $100,000; however, additional problems arose and the vendor was asked to complete the job. The final cost to make the necessary repairs amounted to $117,907.38.

Ongoing repairs and testing is time consuming and costly as we move forward to bring the fuel sites into compliance by January 1, 2009. Our failure to remedy the fuel sites at various locations throughout the City could result in costly fines to the City.

This matter was reviewed by Deputy City Attorney Lori Conway on June 18, 2007, and Budget and Performance Management Officer David Wodynski on June 19, 2007.

TIMING CONSIDERATIONS
City Council action on this matter is requested on July 3,2007, to meet the City's obligation for services rendered.

FISCAL IMPACT
