TITLE
Recommendation to authorize City Manager to execute a Public Walkways Occupancy Permit for sidewalk dining at La Creperie Café located at 4911 East Second Street.  (District 3)
 
DISCUSSION
Creperie Express, Inc., the new operator of La Creperie Café, requests a permit to temporarily occupy part of the adjoining sidewalk for the purpose of sidewalk dining at 4911 East Second Street.  This restaurant, previously operated by Crepes 1, Inc., has had a permit in good standing for over five years.  The proposed permit area and a list of furnishings and accessories to be placed in the permit area are shown on the attachment.  Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code which describes temporary uses of public right-of-way.  The width of the sidewalk is 13 feet and six inches.  At least five feet will be maintained between the sidewalk-dining area and other sidewalk obstructions.  If approved, the use of the permit area will be restricted to the hours between 10:00 a.m. and 11:00 p.m.
 
The Long Beach Fire Department reviewed and approved this request on February 8, 2011.  Deputy City Attorney Linda Trang prepared the subject permit on April 5, 2011.  Budget Management Officer Victoria Bell reviewed this item on May 25, 2011.
 
TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
 
FISCAL IMPACT
A security deposit of $546 and a permit-processing fee of $546 were deposited into the General Fund (GP) in the Department of Public Works (PW).  There will be no local jobs impacted by this recommendation.
 
SUGGESTED ACTION
Approve recommendation.
