DISCUSSION
The owners of the Baja Sonora Grille at 70 Atlantic Avenue request a first time permit to temporarily occupy part of the adjoining sidewalk with portable fixtures for the purpose of sidewalk dining. The proposed permit area and a list of furnishings and accessories are shown on the attached Exhibit A. Approval of this permit is based on the conditions and standards of Chapter 14.14 of the Long Beach Municipal Code, which describes temporary uses of public rights-of-way. The previous restaurant at this location, Mango Fool, had a permit for sidewalk dining over the same area. This area includes sidewalk immediately in front of the restaurant and sidewalk in front of the Travelodge Hotel pool enclosure (the restaurant occupies part of the Travelodge Hotel building). The owners of the Travelodge Hotel provided their written consent for the issuance of this permit.
 
The width of the sidewalk at this location is 20 feet, and a minimum clearance of 5 feet shall be maintained between the permit area and the streetlight adjacent to the restaurant and Atlantic Avenue. Deputy City Attorney Lisa Pes kay Malmsten prepared the subject permit on November 17, 2003.
 
TIMING CONSIDERATIONS
City Council action on this matter is not time critical.
 
FISCAL IMPACT
A permit-processing fee of $1,062 was deposited to the General Fund (GP) in the Department of Public Works (PW).
