DISCUSSION
In 2013, the Friends of Long Beach Animal Shelter, a California nonprofit public benefit corporation, doing business as Friends of Long Beach Animals (FOLBA), proposed the donation and installation of a 60' by 13'-4" CAVCO Industries, Inc., manufactured commercial building.  The building would be installed at the P.D. Pitchford Companion Animal Village (Animal Village), located at 7700 East Spring Street (Attachment), for use by FOLBA and the City of Long Beach (City) as a dual-purpose veterinary clinic (DPVC).  In exchange for the aforementioned donation, FOLBA has proposed the provision of low-cost spay and neuter clinics at the Animal Village, utilizing the DPVC. The Department of Parks, Recreation and Marine's (PRM) Animal Care Services Bureau (ACS) would use the DPVC during regular operational hours, and FOLBA would have access on Monday and Tuesday of each week, when the ACS facility is closed, in order to conduct spay and neuter clinics for animals under ACS' care, as FOLBA's budget permits. PRM intends to return to the City Council at a later date for its consideration of a new Cooperative Agreement between FOLBA and the City to provide for the joint use of the DPVC.
 
Concurrent to the aforementioned proposal, $50,000 in one-time funding was appropriated in Fiscal Year 2014, for an ACS veterinary clinic.  PRM shall use up to $50,000 of this one-time funding to outfit the interior of the DPVC and make sure it is adequately equipped to handle its clinical needs. PRM anticipates no other expenditures related to the installation of the DPVC beyond this one-time funding, as all contingencies will be borne solely by FOLBA.  PRM shall assume ownership and absorb the cost of all utilities to the DPVC after it is installed, as it would for any public building.
 
The area on which the DPVC will be installed is on a City-owned parcel of land that is leased to the Society for the Prevention of Cruelty to Animals Los Angeles (SPCALA), pursuant to Lease No. 25915, which is, in turn, leased back to the City, pursuant to Lease No. 25916.  Although the City technically owns the property, SPCALA's consent to the installation of the DPVC is required, and has been obtained by PRM.  FOLBA shall be responsible for obtaining all applicable approvals and permits from the County of Los Angeles, the Department of Development Services, the Department of Financial Management, and/or the Public Works Department.
 
This matter was reviewed by Deputy City Attorney Gary J. Anderson on December 31, 2013, and by Budget Management Officer Victoria Bell on January 2, 2014.
 
TIMING CONSIDERATIONS
City Council action is requested on January 21, 2014, in order to enable the execution of the right-of-entry permit and any related documents to allow the Friends of Long Beach Animals, and/or its agents, to begin work on installing the DPVC as soon as possible.
 
FISCAL IMPACT
There will be a slight increase to utilities at the Animal Village from the recommended action, although the exact amount is unknown at this time.  Any increase to utilities at the Animal Village shall either be absorbed into the General Fund (GP) in the Parks, Recreation and Marine Department (PR), or offset by a potential reduction in offsite contracted veterinary services resulting from the City's use of the DPVC.  A maximum of $50,000 shall be paid by the City to outfit and equip the DPVC, as appropriated in the FY14 budget in the General Fund (GP) in the Parks, Recreation and Marine Department (PR).  There is no impact to jobs associated with the recommended action.
