TITLE

Recommendation to authorize City Manager, or designee, to grant an easement to the Metropolitan Water District of Southern California (MWD), a public corporation, for the reconstructed facilities related to water transportation at 3559 Clark Avenue;

 

Authorize City Manager, or designee, to accept a quitclaim deed to release a portion of MWD’s interest in the current utility access easement at 3559 Clark Avenue; and

 

Accept Categorical Exception No. CE-21-019.  (District 5)

 

DISCUSSION

On July 4,1968, the Metropolitan Water District of Southern California (MWD) was granted an exclusive permanent easement to construct, reconstruct, maintain, operate, enlarge, remove, and replace facilities necessary and convenient for water transportation, along the Rosie the Riveter Park property at 3559 Clark Avenue. MWD is proposing to relocate the existing water transportation facilities in the area.

 

As a result of this facility relocation, MWD is requesting a grant of easement for facilities to be relocated outside of the existing easement area and seeks to quitclaim portions of the existing easement back to the City that will no longer be used by MWD (Attachments A and B). The necessary City departments, including Parks, Recreation and Marine and Public Works, have reviewed the proposed easement and quitclaim deeds and have no objections to the actions. The Department of Public Works seeks City Council approval to grant the requested easement and execute the quitclaim deed.  

 

In conformance with the California Environmental Quality Act, Categorical Exemption No. CE-21-019 was issued on February 26, 2021 (Attachment C). 

 

This matter was reviewed by Deputy City Attorney Erin Weesner-McKinley on March 17, 2021 and by Budget Management Officer Rhutu Amin Gharib on April 28, 2021.

                     

TIMING CONSIDERATIONS

City Council action on this matter is not time critical.

 

FISCAL IMPACT

An easement processing fee in the amount of $3,313 and a quitclaim processing fee in the amount of $3,313 were deposited in the General Fund Group in the Public Works Department. This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities.  There is no local job impact associated with this recommendation.
