TITLE
Recommendation to request City Attorney to prepare an ordinance amending Long Beach Municipal Code Title 10 Vehicles and Traffic, Chapter 10.02 Definitions and Chapter 10.28 Parking Meters, to clarify the definition of “Holidays” that are exempt from parking meter enforcement. (Citywide)
DISCUSSION
City Council action is requested to amend Title 10 Vehicles and Traffic, Chapter 10.02 Definitions and Chapter 10.28 Parking Meters of the Long Beach Municipal Code (LBMC).
LBMC Section 10.02.030 - Holidays states that the City shall rely on California Government Code Section 6700 to define Vehicles and Traffic Holidays, which may be amended from time to time. As currently written, California Government Code Section 6700 defines over 40 days in the calendar year as holidays, subject to change at the state’s pleasure. To better clarify parking enforcement on holidays and to provide more effective enforcement citywide, staff is recommending amending LBMC Section 10.02.030 pertaining to the definition of Vehicles and Traffic Holidays so that specific holidays will be exempt from enforcement in the City.
Moreover, LBMC Chapter 10.28 - Parking Meters pertains to the operation and enforcement of parking meters citywide, but it does not clearly state the holidays exempt from parking enforcement. To provide more effective parking meter enforcement citywide, staff is also recommending amending LBMC Section 10.28 pertaining to the enforcement of Vehicles and Traffic Parking Meters so that specific holidays will be exempt from parking meter enforcement in the City.
The following holidays are proposed as being exempt from parking meter enforcement:
1. New Year’s Day
2. Martin Luther King Jr. Day
3. Presidents’ Day
4. Memorial Day
5. Independence Day
6. Labor Day
7. Thanksgiving Day
8. Day after Thanksgiving
9. Christmas Day
These holidays are consistent with the days exempt from street sweeping parking control enforcement.
If the proposed amendments are adopted, parking enforcement in the downtown core, beach lots, and all other areas will continue to be enforced daily, pursuant to the newly defined holidays as posted.
This matter was reviewed by Deputy City Attorney Linda T. Vu, on April 3, 2018 and by Budget Management Officer Julissa Jose-Murray on March 19, 2018.
TIMING CONSIDERATIONS
City Council action is requested on April 17, 2018, so the LBMC can be amended expeditiously.
FISCAL IMPACT
Amending the LBMC will have no direct fiscal impact. The City will enforce parking meters the same amount of days during the year. There is no local job impact associated with this recommendation.
