DISCUSSION
Based on comments received to-date concerning the Draft Environmental Impact Report (DEIR) for the Airport Terminal Facilities Project, both in writing and at the public meetings held in December, it is anticipated that more hours will be required of the City's EIR consultant, BonTerra Consulting, than anticipated in the original contract, in order to fully respond to these comments. In particular, it is anticipated that the subconsultants for the noise, air quality and health risk portions of the document may require up to 120 hours to prepare comment responses to the noise portion and 240 hours for the air quality and health risk portion. The estimated cost for these services, and other incurred costs such as those for extra outreach meetings, study summaries and additional meetings with regional agencies that were outside of the original scope, is $160,000. Under this contract the City is only billed for actual hours, so the final amount paid for these services may be less than stated, depending upon the extent of the public comments received by the deadline of January 30, 2006. In addition, the current contract expires on February 28, 2006, and it is anticipated that the EIR process will extend beyond that date.
 
Staff is estimating that it will take up to 60 days to respond to comments and prepare the final EIR. Based on this, staff is anticipating that the final EIR will go before the Planning Commission for approval in April 2006. If an appeal is filed, it would be heard by the City Council in late-May or early-June 2006. After consideration of the EIR document, staff will submit an agenda item for City Council action concerning which terminal alternative, if any, should be constructed at the airport. Once this has been determined by the City Council, staff will proceed with the design and construction of the selected alternative. The parking structure will require 3 months of initial design
followed by 18 months of construction. The terminal improvements will require 12 months of design followed by 24 months of construction.
 
This matter was reviewed by Senior Deputy City Attorney Donna F. Gwin on December 27,2005, and Budget Management Officer David Wodynski on December 28,2005.
 
TIMING CONSIDERATIONS
City Council action on this matter is requested on January 17, 2006, to avoid any delays in completing the EIR process for the Terminal Area Improvement Project.
 
FISCAL IMPACT
The recommended amendment to BonTerra's contract for preparation of the requested EIR will increase its current contract amount from $775,000 to $935,000. An appropriation increase will be required to provide sufficient funds to cover the EIR contract amendment in the Airport Enterprise Fund (EF 320) in the Department of Public Works (PW) and is requested in the recommended actions.
