TITLE

Recommendation to authorize City Manager, or designee, to amend Contract No. 35039 with Sully-Miller Contracting Company, of Brea, CA, for additional street improvements to 3rd Street and Broadway, between Magnolia Avenue and Alamitos Avenue, to increase the amount by $550,121, for a revised total amount not to exceed $5,421,321; and authorize City Manager, or designee, to execute all documents necessary, including any necessary amendments.  (Districts 1,2)

 

DISCUSSION

On June 19, 2018, the City Council awarded a contract to Sully-Miller Contracting Company, for street improvements to 3rd Street and Broadway, between Magnolia Avenue and Alamitos Avenue (Project), in the amount of $4,567,200.  The Project provides pedestrian-oriented improvements, which include new sidewalks, continental crosswalks, signage, bus stop islands, and parking-protected bike facilities. 

 

On August 20, 2019, the City Council approved the first amendment to the contract and revised the contract amount to $4,871,200 for additional work required for American with Disabilities Act (ADA) compliance. City Council approval is requested to further amend contract No. 35039, to increase the amount by $550,121, for a revised total amount of $5,421,321.

 

During construction of the Project, a significant amount of additional concrete, sidewalk, and pavement improvements were needed to address unforeseen pavement deterioration.  This was due to numerous utility trenches, uplifted sidewalks by tree roots, and coordination with adjacent private properties and Metro work at the Blue Line.  Solutions developed to address the issues required the usage of bid item amounts greater than the original contract quantities.  These overage quantities, along with a few negotiated items, were not anticipated and increased the final construction cost and contract duration.  Staff requests that City Council approve the contract amendment to allow for release of final payment and Project closeout.

 

This matter was reviewed by Deputy City Attorney Amy R. Webber on March 5, 2020, Purchasing Agent Tara Yeats on March 6, 2020, and by Budget Analysis Officer Julissa José-Murray on March 12, 2020.

 

TIMING CONSIDERATIONS

City Council action is requested on April 14, 2020, to ensure timely Project completion.

 

FISCAL IMPACT

The revised total contract amount will not exceed $5,421,321.  There is sufficient County Prop C appropriation in the Capital Projects Fund Group in the Public Works Department to support the $550,121 increase to the contract.  This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities.  There is no local job impact associated with this recommendation.
