DISCUSSION
City Council approval is being requested authorizing the City Manager to award contracts for providing lead-based paint and other home hazard control services to ensure U.S. Department of Housing and Urban Development (HUD) compliance for the City's Department of Health and Human Services.
 
The Department of Health and Human Services has received nearly $3 million in cost-reimbursement grants from HUD, Office of Lead Hazard Control and Healthy Homes, through the American Reinvestment and Recovery Act (ARRA). The grant provides total funding of up to $1,007,350 for the control of lead-based paint hazards within affordable housing occupied by low-income residents. The grants also include support for tenant relocation, lab analysis, health education and risk assessment.
 
An invitation to bid was advertised in the Press-Telegram on September 15, 2009. The bid document was made available from the Purchasing Division, located on the seventh floor of City Hall, and the Division's website at www.longbeach.gov/purchasing. A bid announcement was also included in the Purchasing Division's weekly update of Open Bid opportunities, which is sent to 30 local, minority and women's business groups. Twenty potential bidders attended the Bidder's Conference and 12 bids were received. Of those 12 bidders, 1 is a Woman-owned Business Enterprise (WBE), 3 are Minority-owned Business Enterprises (MBEs), 5 are certified Small Business Enterprises (SBEs) and 3 are Long Beach Businesses. Bids were opened on October 6, 2009. In compliance with ARRA contracting guidelines, the Department of Health and Human Services, in conjunction with the Purchasing Division, recommends seven vendors as approved contractors: Matrix Environmental, Inc., of Long Beach, CA (WBE, local); HDR Corporation of Long Beach, CA (SBE, local); Batres Alcides of Long Beach, CA (local); Metalclad Insulation Corporation of Fullerton, CA (not a MBE, WBE, SBE or local); Universal Abatement Services of Los Angeles, CA (MBE, SBE); Vizion's West, Inc., of Quail Valley, CA (not a MBE, WBE, SBE nor local); and Watson Painting Corporation of Riverside, CA (MBE). Approved contractors will subsequently bid on each individual project as they accrue, this process will be managed by the Department of Health and Human Services.
 
Local Business Outreach
 
When the bid was advertised, Purchasing Division staff individually contacted 12 Long Beach businesses that specialize in lead abatement services. Our outreach goal during the bid process is to encourage Long Beach businesses to take advantage of local preferences offered by the City and submit bids for City contracts. We assist businesses with registering on our Bids Online database to download the bid specifications. Of the 3 bids received from Long Beach businesses, all three were deemed responsible low bidders and are being recommended for award.
 
This matter was reviewed by Deputy City Attorney Amy Burton on November 16, 2009 and Budget and Performance Bureau Manager Officer David Wodynski on November 10, 2009.
 
TIMING CONSIDERATIONS
City Council action to adopt Specifications No. PA-02909 and award contracts concurrently is requested on December 1, 2009 to ensure HUD compliance and allow the individual project bidding to proceed expeditiously.
 
FISCAL IMPACT
The annual cost of the contracts is $500,000, and will be financed in full with grants from HUD's Office of Lead Hazard Control and Healthy Homes, cost-reimbursement grant. Sufficient funds are budgeted in the Health Fund (SR 130) in the Department of Health and Human Services (HE). The City will have the option of adding expenditures up to 10 percent (or $50,000) above the contract amounts, if necessary and if funds are available.
