TITLE
Recommendation to adopt resolution making certain findings regarding the construction of certain public improvement projects with North Long Beach Redevelopment Project Area Funds. (District 9)
DISCUSSION
On July 13, 2009, the State Water Resources Control Board (SWRCB) and the City of Long Beach (City) entered into a project finance grant agreement through the Clean Water State Revolving Fund under the American Recovery and Reinvestment Act (ARRA) for improvements to the Pump Station SD13 in North Long Beach. The project was advertised for bid on October 23, 2009, and bids were opened on November 19, 2009. The Long Beach City Council approved a contract with the lowest responsive bidder, Humphrey Constructors, on December 15, 2009.
The storm drain project is designed to assist in the removal of blight through the capture and removal of trash and debris prior to entering storm drain pumps. This will significantly reduce the amount of trash and debris discharged into the Los Angeles River. A vicinity map of the area is attached as Exhibit A.
The Department of Public Works does not have sufficient funds to cover the full project, particularly related to architectural, engineering, and other soft costs. Since no other reasonable means of financing have been found, the Long Beach Redevelopment Agency (Agency) proposes to subsidize the unfunded balance of the project.
California Redevelopment Law provides that the Redevelopment Agency may, with the consent of the City Council, pay for public improvements that are publicly owned either within or outside of a Redevelopment Project Area, if the City Council determines all of the following:
· That the construction of such public improvements is of benefit to the redevelopment project area or the immediate neighborhood in which the public improvement project is located.
· That no other reasonable means of financing the public improvements are available to the community.
· That the payment of Redevelopment Agency funds for the construction of the public improvements will assist in the elimination of one or more blighting conditions within the project area.
Since the Agency is funding construction of these public improvements, these findings must be made. The Redevelopment Agency made the necessary findings on January 4, 2010.
These public improvements include the construction of a storm drain netting system that will further serve to support neighborhood and economic revitalization by reducing trash and debris discharged into the Los Angeles River, thereby enriching the character of neighborhoods, improving open space elements, and providing a unique and positive environmental signature for the Project Area.
A resolution is attached making certain findings regarding the construction of these public improvements with redevelopment funds in the Project Area.
This letter was reviewed by Chief Assistant City Attorney Heather A. Mahood on December 29, 2009 and by Budget and Performance Management Bureau Manager David Wodynski on December 29, 2009.
SUSTAINABILITY
This trash net system, similar to those installed at other City pump stations (SD1, SD3, SD4, SD5, & SD6), has proven to be very effective at capturing trash, sediment and green waste. An additional benefit derived from the netting system is that bacteria attached to the trash and debris will also be captured, improving the quality of the stormwater runoff water being discharged to the Los Angeles River.
TIMING CONSIDERATIONS
City Council action on this matter is requested on January 19, 2010, as the City Council authorized commencement of this Public Works project on December 15, 2009 (Exhibit B - December 15, 2009, City Council letter). Construction is projected to begin in February 2010 and should take approximately 60 working days.
FISCAL IMPACT
The previously awarded contract is for an estimated amount of $367,900, plus a 15 percent contingency of $55,185, if necessary. Funds to cover the contract are budgeted in the Capital Projects Fund (CP 201) in the Department of Public Works (PW). Additional
