TITLE
Recommendation to authorize City Manager to enter into miscellaneous agreements with Orange County Transportation Authority (OCTA) and the California Department of Transportation (CalTrans) in order to protect a segment of City-owned natural gas pipeline in connection with the widening of State Route 22 (SR 22) between Seal Beach Boulevard and Bolsa Chica Road in the County of Orange.  (Citywide)
 
DISCUSSION
The City of Long Beach owns a natural gas pipeline commonly known as Line 1228, which runs from Long Beach to Huntington Beach. An approximately two-mile segment of Line 1228 is buried immediately southwest and adjacent to portions of SR 22. The Seal Beach Boulevard Bridge and SR 22 are being widened by OCTA to accommodate the expansion of the SR 22/405 Freeway. OCTA is prepared to protect Line 1228 in place in order for the City to avoid considerable relocation costs. Various administrative documents in connection with the expansion of SR 22 and Line 1228 protection measures are anticipated to require execution. OCTA currently requires the City to execute a utility agreement to enable Long Beach Gas & Oil Department (LBGO) to provide construction inspection services. LBGO's costs for these services are estimated at approximately $39,000, which will be reimbursed by OCTA.
 
This matter was reviewed by Deputy City Attorney Richard Anthony on November 9, 2009 and by Budget and Performance Management Bureau Manager David Wodynski on November 12, 2009.
 
TIMING CONSIDERATIONS
City Council action is requested on December 15, 2009, to authorize execution of the utility agreement in order to maintain project schedule, as the freeway widening is currently in engineering.  
 
FISCAL IMPACT
Revenue generated by construction inspection services of $39,000 will be deposited in the Gas Fund (EF 301) in the Gas and Oil Department (EN). There is no other significant fiscal impact with the recommendation authorizing the City Manager or his designee to execute documents with OCT A and Caltrans.
