TITLE

DISCUSSION
U.S. Communities is a nonprofit organization that assists local and state government agencies, nonprofit organizations, school districts (K-12), and other educational organizations in reducing the cost of purchased goods through the pooling of purchasing power of public agencies nationwide. This is accomplished by competitively solicited contracts for quality products through leading public agencies.
 
More than 35,800 public agencies utilize U.S. Communities contracts and suppliers to procure more than one billion dollars in products and services annually. Each month, more than 400 new public agencies register to participate. The continuing rapid growth of public agency participation is fueled by the program's proven track record of providing public agencies unparalleled value.
 
The playground equipment at Mother's Beach is more than 15 years old, and includes several pieces that are no longer functional and/or do not meet ADA accessibility requirements. This is one of the last playgrounds in the city to be retrofitted to conform to ADA requirements. The new playground will meet universally accessible playground standards. City Council approval is being requested to enter into a contract with Landscape Structures, Inc., (LSI) to replace the existing equipment at Mother's Beach playground, under the City's current U.S. Communities contract.
 
This matter was reviewed by Deputy City Attorney Gary J. Anderson on April 21,2009, and Budget and Performance Management Bureau Manager David Wodynski on April 20, 2009.
 
SUSTAINABILITY
 
Landscape Structures, Inc., is the only manufacturer of playground equipment that is certified ISO 14001 :2004 for its commitment to an environmentally-conscious manufacturing process. The company recently received the Minnesota Waste Wise award from the Minnesota Chamber of Commerce for increasing recycling, reducing waste, and reducing energy consumption.  
 
TIMING CONSIDERATIONS
City Council action is requested on May 12, 2009, in order to execute the contract in a timely manner.
 
FISCAL IMPACT
The cost for the new playground equipment is $105,378. Sufficient funds to cover the contract are budgeted in the Tidelands Fund (TF) in the Department of Parks, .
Recreation and Marine (PR).
