TITLE

Recommendation to authorize City Manager, or designee, to execute all documents necessary to amend Contract No. 95866000LBPD24750, with the Los Angeles County Metropolitan Transportation Authority, for providing law enforcement services, to adopt a revised Statement of Work and increase the contract amount by $10,157,293, for a revised contract amount not to exceed $54,238,916, for the term of March 23, 2017 to June 30, 2024.  (Districts 1,2,6,7,8)

 

DISCUSSION

On March 7, 2017, the City Council authorized the Long Beach Police Department (LBPD) to enter into Contract No. PS95866000LBPD24750 with the Los Angeles County Metropolitan Transportation Authority (LACMTA) to provide daily law enforcement services based on an eight-station model focusing on addressing crime, disorder, and reducing the system's vulnerability to terrorism. The total cost of the contract over the five-year period was an amount not to exceed $30,074,628.

 

On October 5, 2021, the City Council approved an amendment to the contract that added one Detective, two Quality of Life Officers and the purchase of one vehicle. Modification No. 3 for these services increased the contract amount by $3,147,962, bringing the total five-year contract amount to $33,222,590.

 

On January 18, 2022, the City Council approved Contract Modification No. 4 that authorized additional funding of $3,730,814 to cover current service levels through the end of the current contract term, June 30, 2022, bringing the total five-year contract amount to $36,953,404.

 

On June 21, 2022, the City Council approved Contract Modification No. 5, 6 and 7 that increased the contract amount by $4,500,000 for a revised contract amount of $41,453,404; extended the term of the contract to December 31, 2022; and allowed an option to extend an additional six-months for a revised contract amount not to exceed $45,953,404. This modification also incorporated the LACMTA required COVID-19 vaccine mandate, and adopted a revised Statement of Work.

 

On February 17, 2023, the City Manager exercised the renewal option as Contract Modification No. 8 that increased the contract amount by $2,628,219 based on actual expenditures for a revised contract amount of $44,081,623 and extended the term of the contract by six (6) months through June 30, 2023. Although City Council authority on June 21, 2022 approved a not to exceed contract amount of $45,953,404 based on projected expenditures, the actuals came in under for a contract total at this time of $44,081,623.

 

On March 16, 2023, LACMTA approved Modification No. 9 that will increase the contract amount by $10,157,293, for a revised contract amount not to exceed $54,238,916, and extend the current contract by one year until June 30, 2024 and change the total Period of Performance to read, March 23, 2017, through June 30, 2024. The Statement of Work (Exhibit A of Contract No. 95866000LBPD24750) will be revised in several areas, including compliance with the LBPD Use of Force Policy, which is consistent with the principles of Campaign Zero “Eight Can’t Wait”, applying LBPD’s Bias Free Policing policy which satisfies the provisions of LACMTA’s Bias-free Policing Policy and complying with principles of the LACMTA Public Safety Analytics Policy, among others.

 

This matter was reviewed by Deputy City Attorney Arturo D. Sanchez on July 11, 2023 and by Budget Management Officer Nader Kaamoush on July 14, 2023.

 

TIMING CONSIDERATIONS

City Council action is requested on August 8, 2023, to amend Contract No. 95866000LBPD24750 to ensure continuity of services.

 

FISCAL IMPACT

The maximum cost of services reimbursed under Contract Modification No. 9 is $54,238,916 for the term of March 23, 2017 to June 30, 2024. The expense associated with the agreement are fully offset by reimbursement revenue from the Los Angeles County Metropolitan Transportation Authority and is budgeted in the General Fund Group in the Police Department. This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities. There is no local job impact associated with this recommendation.
