TITLE

Recommendation to authorize City Manager, or designee, to execute an amendment to accept and expend grant funds from the State of California Department of Parks and Recreation Land and Water Conservation Fund, increasing the award from $2,016,000 to an amount not to exceed $3,656,000, for the period from July 1, 2020 through December 31, 2023, for the Davenport Park Phase II Project;

 

Increase appropriations in the Capital Projects Fund Group in the Public Works Department by $1,640,000, offset by grant revenue; and

 

Increase appropriations in the Capital Projects Fund Group in the Public Works Department by $1,640,000, offset by a transfer of Land and Water Conservation Grant Funds from the State of California Department of Parks and Recreation from the Capital Grants Fund.  (District 8)

 

DISCUSSION

In October 2017, the State of California Department of Parks and Recreation (State Parks) began soliciting applications for the Land and Water Conservation Fund Grant (Grant). This competitive Grant assists local agencies and community-based organizations with acquisition and development of outdoor recreation features that increase opportunities for the health and wellness of Californians. The Land and Water Conservation Fund was signed into law in September 1964 and the program is administered by the National Parks Service with funds allocated to the State of California and administered by State Parks.

 

On December 15, 2020, City Council executed, accepted, and appropriated a grant award, from the State of California Department of Parks and Recreation Land and Water Conservation Fund, in the amount of $2,016,000 for Davenport Park. In 2021, the Parks, Recreation and Marine (PRM) Department approached State Parks about an existing funding gap for Davenport Park. At the time, State Parks was seeking to reallocate funds from a project that was canceled by a different agency and offered additional support for Davenport Park. PRM is requesting the City Manager to execute an amended grant agreement for the Davenport Park Phase II Project, and to accept an additional $1,640,000 in grant funding, bringing the total grant award amount to $3,656,000. Funds awarded through the Grant will contribute to the construction of the western parcel of Davenport Park, increasing the total park size by 5.6 acres.

 

Davenport Park is located at 2910 East 55th Way on the east side of Paramount Boulevard between Candlewood Street and South Street. The Project includes a multi-use sports field, exercise equipment along the existing decomposed granite walking path, and a shaded outdoor seating and activity area. Upon completion of the Project, the land within the Project site will be placed under permanent federal protection to preserve the public’s outdoor recreation use of the site in perpetuity. 

 

This matter was reviewed by Deputy City Attorney Anita Lakhani on March 16, 2023, and by Budget Analysis Officer Greg Sorensen on March 17, 2023.

 

SUSTAINABILITY

 

The Project will provide park amenities, recreational uses, and positive activation where a landfill previously existed. The Project will also use and feature sustainable materials, such as native drought tolerant plants and a water-efficient drip irrigation system.

 

TIMING CONSIDERATIONS

City Council action is requested on April 4, 2023, as the grant agency has provided the City with the grant amendment for signature by the authorized representative and the project performance period has already begun.

 

FISCAL IMPACT

The total cost of the Project is estimated at $9,611,000, which includes design, construction, construction management, inspection, labor compliance, and project oversight. The project is funded by $1,727,963 from Measure A, $2,115,265 in Park Impact Fees, $1,975,000 in grant funding, and $3,500,000 of FY 23 Measure A bond funds currently appropriated in the Capital Projects Fund Group in the Public Works Department. The Grant award will not exceed $3,656,000, with $3,615,680 allocated to the Project and $40,320 for grant-related park planning, community engagement, and grant program administration. The grant has a match requirement of $3,656,000 or 50% of the total project cost, whichever is less. The match is being met by the Measure A and Park Impact Fee funds that are currently appropriated in the project.

 

An appropriation increase for project costs is requested in the amount of $3,280,000 in the Capital Projects Fund Group in the Public Works Department. Of this amount, $1,640,000 will be offset by the State Parks Grant revenue. The remaining amount of $1,640,000 is a technical appropriation to allow for the transfer of State Parks Grant funds from the Capital Grants Fund, a fund within the Capital Projects Fund Group.

 

Upon Project completion, ongoing park maintenance will be the responsibility of PRM. The estimated annual cost of maintenance is $63,000. Funding for this maintenance cost has not been identified, and will be requested by PRM as part of the annual budget process. This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities. The local job impact is unknown at this time.
