DISCUSSION

City Council approval is requested to amend Contract No. 35515 with Nancy K. Bohl, Inc., dba The Counseling Team International, and Contract No. 35516 Psychological Consulting Associates, Inc., to continue providing pre-employment psychological evaluation services, and to expand the scope of work to provide Carry Concealed Weapon license psychological evaluation services. California Penal Code 26190 states that if psychological testing on the initial application is required by the licensing authority, the license applicant shall be referred to a licensed psychologist used by the licensing authority for the psychological testing of its own employees.

 

On February 4, 2020, the City Council awarded contracts Nancy K. Bohl, Inc., dba The Counseling Team International, and Psychological Consulting Associates, Inc., as part of its adoption of RFP PD19-049 for providing pre-employment psychological evaluation services, for a period of two years, with the option to renew for three additional one-year periods.

 

On August 1, 2022, the Los Angeles County Sheriff’s Department transferred the responsibility of issuing Carry Concealed Weapon (CCW) licenses back to the municipal police agencies. The multi-step process to obtain a CCW license includes a detailed application, a background investigation, an interview, a psychological evaluation, and firearm training. Long Beach Police Department requests amendments to the existing contracts because these vendors provide psychological services for pre-employment screening. This request will allow these vendors to offer an additional type of psychological evaluation for CCW license applicants.

 

This matter was reviewed by Deputy City Attorney Arturo D. Sanchez on June 1, 2023, Purchasing Agent Michelle Wilson on May 26, 2023, and by Budget Management Officer Nader Kaamoush on June 2, 2023.

 

TIMING CONSIDERATIONS

City Council action is requested on June 20, 2023, to amend Contract Nos. 35515 and 35516, to ensure there is no interruption to services.

 

LEVINE ACT

 

This item is subject to the Levine Act. The Mayor, Councilmembers, and Commissioners who have received a contribution of more than $250 within 12 months prior from a party, participant, or their representatives involved in this proceeding may do either of the following: (1) disclose the contribution on the record and recuse themselves from this proceeding; OR (2) return the portion of the contribution that exceeds $250 within 30 days from the time the elected official knew or should have known about the contribution and participate in the proceeding.

 

All parties, participants, and their representatives must disclose on the record of this proceeding any contribution of more than $250 made to the Mayor or any Councilmembers within 12 months prior to the date of the proceeding. The Mayor, Councilmembers, and Commissioners are prohibited from accepting, soliciting, or directing a contribution of more than $250 from a party, participant, or their representatives, during a proceeding and for 12 months following the date a final decision is rendered.

 

FISCAL IMPACT

The requested amendment will expand the scope of work allowed under the contracts, with the same terms and limits. No additional contract authority is requested to these contract amendments. Funds for these services are budgeted in the General Fund Group in the Police Department. This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities. There is no local job impact associated with this recommendation.
