TITLE

DISCUSSION
Mr. Larry Curtis has conducted and directed the Long Beach Municipal Band since 1993, under contract with the Department of Parks, Recreation and Marine. Mr. Curtis is an acclaimed conductor who has directed renowned orchestras and ensembles in Japan, Scotland, Canada, England, Austria, Switzerland, Germany, Australia, and throughout the United States, including the Lincoln Center and the Hollywood Bowl. The most recent agreement governing the terms and conditions for his services was approved by the City Council on February 21, 2006, and has now expired. The Municipal Band program, along with this contract, is supported by the Tidelands and the Special Advertising and Promotions Funds.
 
For the proposed 2009 eight-week concert season, Mr. Curtis will once again provide services as Conductor/Director of the Municipal Band. This responsibility entails developing the musical program for the season, as well as personally conducting each performance. In addition to these basic responsibilities, Mr. Curtis will be involved in developing a theme for each concert series, producing written descriptions of the musical selections for program brochures, and providing consultation on program material design and fundraising. Mr. Curtis will assist with the recruitment, selection, and scheduling of all performers, musicians, and other personnel working with the Municipal Band.
 
The proposed 2009 agreement remains unchanged in services and price, with the following major terms and conditions:
 
• Contract Amount: Mr. Curtis will be paid a total amount not to exceed $59,000 for all services, including pre-concert and post-concert season services, rehearsals, and concert performances.
 
• Term: The City and Mr. Curtis shall have the option, subject to mutual consent, to extend the term of the agreement for two consecutive periods of one year each, at the sole discretion of the City Manager or his designee.
 
This matter was reviewed by Deputy City Attorney Gary J. Anderson on January 15, 2009, and Budget Management Officer Victoria Bell on January 15, 2009.
 
TIMING CONSIDERATIONS
City Council action is requested on February 3, 2009, to allow timely execution of the agreement and pre-concert season activities.
 
FISCAL IMPACT
The proposed agreement with Mr. Curtis is for an amount not to exceed $59,000 per year, which is included in the annual Municipal Band budget. Sufficient funding is budgeted in the Department of Parks, Recreation and Marine Tidelands Fund (TF) and the Special Advertising and Promotions Fund (SR).
