TITLE
Recommendation to authorize City Manager, or designee, to execute all documents necessary, and any subsequent amendments with the Union Pacific Railroad Company, of Omaha, NE, for the purpose of permitting multiple utility crossing construction in railroad Right-of-Way for delivery of Plans and Specifications No. R-7191 Artesia Great Boulevard Project. (Districts 8,9)
DISCUSSION
City Council approval is requested to enter into an agreement with Union Pacific Railroad Company (UPRR) to permit construction of new utility crossings as represented by Plans and Specifications No. R-7191, Artesia Great Boulevard Project, authorized by City Council at its meeting on October 11, 2022.
The Public Works Department is actively engaged in a series of Complete Street and Active Transporation improvements along the 3.2 mile length of Artesia Boulevard from Harbor Avenue/Susana Avenue to Downey Avenue for the construction of the Artesia Great Boulevard Project (Project). UPRR does not own the property, but owns and operates on trackage and easements located across, on, over, under and upon the subject property, which bisects the Project limits. The Public Works Department is required to obtain authorization from UPRR for each underground and utility crossing at the railroad right-of-way (Attachment A).
This matter was reviewed by Deputy City Attorney Vanessa S. Ibarra and by Budget Management Officer Nader Kaamoush on June 2, 2023.
TIMING CONSIDERATIONS
City Council action is requested on June 20, 2023, to ensure the permit is in place expeditiously.
FISCAL IMPACT
Permit fees related to this project are anticipated and included in the project budget. No additional appropriation is needed at this time. This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities. The number of additional local jobs created by this project will not be known until the contractors have completed their hiring and construction has commenced.
