DISCUSSION

City Council approval is requested to amend Contract No. 36174 with Gordian Group, Inc. (Gordian), for Job Order Contracting (JOC) program and software support. The JOC program is used to complete various improvements to City of Long Beach (City) assets such as City buildings, parks, and housing and homelessness capital projects overseen by the Public Works Department.

 

On November 9, 2021, the City Council awarded a contract to Gordian as part of its adoption of Resolution No. RES-21-0136 to provide JOC program and software support in an amount not to exceed $1,000,000, for a period of two years, with the option to renew for two additional one-year periods. On January 24, 2023, the City Council declared Emergency Ordinance No. ORD-23-0003 amending the Long Beach Municipal Code by adding Section 2.84.170, to temporarily suspend certain provisions of Chapter 2.84 during the proclaimed local emergency caused by homelessness. The increased JOC program use as a result of the local emergency caused by homelessness will result in increased expenditures for program and software support provided by Gordian.

 

According to City's 2023 Point in Time Count, the City has approximately 3,450 people experiencing homelessness. Homelessness has disproportionately impacted Black, Indigenous, and Pacific Islander Long Beach residents who are approximately three times more likely to experience homelessness than other populations. Black people comprise only 12 percent of the population of the City but, in the most recent homelessness count, completed in January 2023, accounted for approximately 30 percent of people experiencing homelessness. Approximately 38 percent of people experiencing homelessness have experienced violence or trauma in their lives. The number of students experiencing homelessness has grown by approximately 2.5 percentage points since 2022.

 

The JOC project delivery system provides a significant benefit to the City, including faster completion of projects, cost savings, and reduced complexity of processes. The City uses the JOC program regularly for smaller construction projects like roof repairs, doorway replacements, tenant improvements, painting, park improvements, demolition, electrical maintenance, and other repairs including emergency requests. Adopted contractors are prequalified and enter a competitively bid, fixed price, multi-year construction contract based on an established Construction Task Catalog for construction projects. The JOC program is used as a timely and cost-effective option for the delivery of renovation, repair and minor construction projects.

 

Projects required to respond to the proclaimed emergency over homelessness include various tenant improvements required at recently purchased hotels, improvements required to quickly create additional emergency shelters, and other projects critical to increasing services for people experiencing homelessness.

LEVINE ACT

 

This item is subject to the Levine Act. The Mayor, Councilmembers, and Commissioners who have received a contribution of more than $250 within 12 months prior from a party, participant, or their representatives involved in this proceeding may do either of the following: (1) disclose the contribution on the record and recuse themselves from this proceeding; OR (2) return the portion of the contribution that exceeds $250 within 30 days from the time the elected official knew or should have known about the contribution and participate in the proceeding. All parties, participants, and their representatives must disclose on the record of this proceeding any contribution of more than $250 made to the Mayor or any Councilmembers within 12 months prior to the date of the proceeding. The Mayor, Councilmembers, and Commissioners are prohibited from accepting, soliciting, or directing a contribution of more than $250 from a party, participant, or their representatives during a proceeding and for 12 months following the date a final decision is rendered.

 

TIMING CONSIDERATIONS

City Council action to amend Contract No. 36174 is requested on October 10, 2023, to ensure there is no interruption to services.

 

FISCAL IMPACT

The requested action increases the Contract authority with Gordian by $400,000. The total revised annual contract amount will not exceed $1,400,000. Contract authority is only expended as work orders are authorized through the JOC program. Actual costs will be based on the work required and projects implemented to respond to the homelessness crisis. No appropriation increase is necessary at this time. Any work not currently budgeted will only proceed at such time that appropriations have been approved by the City Council. This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities. There is no local job impact associated with this recommendation.
