TITLE

Recommendation to authorize City Manager, or designee, to execute all documents necessary to amend the existing Cooperative Agreement between the City of Long Beach and the City of Signal Hill for the construction of the Los Cerritos Channel Sub-Basin 4 Stormwater Capture Facility Project; to increase the reimbursement amount from $50,000 to $350,000 for additional City of Long Beach administrative costs.

DISCUSSION

The cities of Signal Hill (Signal Hill) and Long Beach (City) are members of the Los Cerritos Channel (LCC) Watershed Group. Per the Clean Water Act (CWA), a stormwater capture facility is being constructed to provide subterranean capture and treatment of stormwater runoff to reduce stormwater and non-stormwater metals and bacteria pollution discharges from both cities prior to outflow into the LCC and ultimately the Pacific Ocean. The subject facility is located on northeast side of the intersection of Spring Street and Lakewood Boulevard within Long Beach Airport property.

 

On June 16, 2015, Signal Hill adopted a Cooperative Implementation Agreement with Caltrans for up to $11 million in funding for the design and construction of this project. This agreement allows for the reimbursement of up to $50,000 for work performed by City staff through project completion. The Signal Hill Public Works Department has been taking the lead in providing project oversight and funding. The City has been participating in the design and construction review process and providing coordination with rights-of-way permits and general project support.

 

To facilitate moving coordination between the two cities for this project, Signal Hill and the City entered into a Cooperative Agreement for the construction of the subject stormwater capture facility, which was approved by the City Council on January 19, 2016 (Exhibit A). The existing agreement indicates the reimbursement amount of up to $50,000 for City administrative costs.

 

Before the start of construction, the project location was moved onto Long Beach Airport property. This change benefitted the project but added costs due to additional oversight from Airport staff, repair of the perimeter road, and addressing differing soil conditions. These changes increased the City's reimbursement amount to $350,000.

 

This matter was reviewed by Deputy City Attorney Amy R. Webber on August 21, 2017 and by Budget Analysis Officer Julissa Jose-Murray on September 7, 2017.

 

TIMING CONSIDERATIONS

City Council action is requested on October 3, 2017, to proceed with the project.

 

FISCAL IMPACT

The design and construction of the project is being funded by Signal Hill, through an $11 million grant received by Caltrans. The original project budget includes reimbursement of up to $50,000 for City administrative costs, such as project support and rights-of-way permits. The updated project budget includes reimbursement of up to $350,000 for City administrative costs. The Public Works Department (PW) will request appropriations for its project expenses to be offset by reimbursement revenue received from Signal Hill once the agreement is finalized.
