TITLE
Recommendation to authorize City Manager to execute a permit with Steve Kent, an individual doing business as Kites Etc. 2, to operate a kitesurfing and stand-up paddle surfing concession for a one-year term, with two, two-year renewal options, at the discretion of the City Manager or his designee. (District 3)
DISCUSSION
Steve Kent, an individual doing business as Kites Etc. 2 (Kites) has operated a kite surfing concession on City beaches since 2003, offering kitesurfing lessons, rentals, sales of sundry related products, and repair services. Kitesurfing, also known as kiteboarding, involves using the power of a large controllable kite to propel the rider and the specialized surfboard across the water. The calm water and steady onshore winds found along Long Beach's shoreline make it an ideal location for this sport.
This year, Kites is requesting authorization for a new permit to include a stand-up paddle surfing concession (SUP). SUP is a surface water sport where the surfer uses a paddle to move through the water while standing on the surfboard. This aspect of surfing has seen a recent resurgence in the Hawaiian Islands and is rapidly growing in Southern California. Kites will operate Tuesday through Saturday from 9:00 a.m. to 4:00 p.m., year-round, except for Thanksgiving Day, Christmas Day, and New Years Day, with extended hours during the summer season.
The following are major provisions of the proposed permit:
· Premises: City beaches, as shown on aerial photo (Attachment A).
· Permitted Use: Operation of a kite and stand-up paddle surfing concession to
include lessons, rentals, the sale of sundry items, and repair services.
· Term: One year, through April 30, 2009.
· Renewal Options: Two, two-year renewal options, at the discretion of the City
Manager or his designee.
· Permit Fee: Ten percent of annual gross receipts or an annual minimum amount
of $3,000, whichever is greater.
· Insurance: Kites Etc. 2 shall provide insurance coverage as defined by the City's
Risk Management Office.
· Kitesurfinq Guidelines: Kites Etc. 2 shall comply with the City of Long Beach
Kiteboarding Guidelines and shall maintain its Professional Air Sports Association
certified school status throughout the term of the permit.
This matter was reviewed by Principal Deputy City Attorney J. Charles Parkin on April 7, 2008, and Budget Management Officer Victoria Bell on April 8, 2008.
TIMING CONSIDERATIONS
City Council action is requested on April 22, 2008, to enable the execution of the permit.
FISCAL IMPACT
Annual revenue in the amount of $3,000 will accrue to the Tidelands Fund (TF) in the Department of Parks, Recreation and Marine (PR).
