TITLE
Recommendation to adopt resolution authorizing City Manager to execute a contract with Long Beach BMW for the purchase of six (6) BMW police certified motorcycles per quote dated August 2, 2007, on the same terms and conditions afforded to the State of California, in an amount not to exceed $134,115.26 including tax, with the option to purchase additional units, plus a ten percent contingency for additional equipment if necessary and if funds are available. (Citywide)
DISCUSSION
City Council approval is being requested authorizing the City Manager to execute a contract for the purchase of six (6) BMW motorcycles for the Long Beach Police Department.
The Long Beach Police Department is currently utilizing six (6) Kawasaki motorcycles that are seven (7) years old with a scheduled life expectancy of five (5) years. These motorcycles were originally scheduled FY 06 replacements that were reviewed and approved by the Fleet Review Committee. Due to funding issues and the lack of Police Department Motor Officers, on-going research for other available equipment options deferred replacement of these motorcycles until FY 08.
The Police Department's primary front-line motorcycle is BMW. With the addition of staff from Prop H funding, the purchase of these new BMW motorcycles are necessary to maintain a consistent standardization of the fleet and eliminates the need for additional training for mechanics and officers.
The City Charter provides an alternative procurement method by permitting the City to purchase or otherwise obtain services, supplies, materials, equipment and labor with other governmental agencies by purchasing under their contracts on a voluntary and selective basis when authorized by a Resolution of the City Council.
The Department of Public Works, Fleet Services Bureau, investigated procurement options and learned that the State of California had completed a competitive bid process for police certified motorcycles and has a contract with Long Beach BMW that meets the City's needs. This cooperative purchase agreement will facilitate the timely acquisition of these motorcycles and provide cost benefits to the City.
Long Beach BMW has agreed to sell six (6) BMW police certified motorcycles to the City of Long Beach under the same terms and conditions as are afforded to the State of California in an amount not to exceed $134,115.26 including tax, with the option to purchase additional units, and with an option for 10 percent contingency if necessary and if funds are available. The Matrix Fleet Review Study also supports the use of cooperative purchase agreements and adherence to a long-term replacement plan.
This matter was reviewed by Deputy City Attorney Lori A. Conway on November 7 2007 and Budget Management Officer Victoria Bell on November 7, 2007.
TIMING CONSIDERATIONS
City Council action is requested on November 20, 2007, to ensure that the new motorcycles are built and placed into service in conjunction with the new graduating class of Police Motor Officers.
FISCAL IMPACT
The cost of this contract, in the amount of $134,115.26 (including tax of $10,221.26), is included in the Fleet Services Fund (IS 386) in the Department of Public Works (PW).
