TITLE
Recommendation to adopt resolution authorizing City Manager to execute a contract with Sharp Electronics Corporation for the purchase, lease, maintenance and supplies of Sharp multi-function devices, on the same terms and conditions afforded the National Joint Powers Alliance (NJPA), Contracts No. 021808-SP (3/20/08 through 3/19/12) and No. 101802 (3/27/03 through 3/28/08), in an annual amount not to exceed $700,000 including tax, plus a 10 percent contingency if necessary and if funds are available. DISCUSSION
City Council approval is requested authorizing the City Manager to execute a contract for the purchase, lease, maintenance and supplies of Sharp multi-function devices for various departments in the City.
The City Charter provides for an alternative procurement method by permitting the City to purchase or otherwise obtain services, supplies, materials, equipment and labor with other governmental agencies by purchasing under their contracts on a voluntary and selective basis when authorized by a Resolution of the City Council.
On January 26, 1999, the City Council adopted Resolution No. C-27474 approving a leasing and maintenance contract (No. 26089) under a California Multiple Award Schedule (CMAS) with Sharp Electronics Corporation (Sharp). After seven amendments, this contract ended on December 31, 2007. Although the City was informed that the CMAS contract would be extended another year, we recently learned it would not be renewed. However, the NJPA contract affords the City the opportunity to continue its long-standing relationship with Sharp. This cooperative purchase agreement will facilitate the ability to pay maintenance and supplies for these multi-function devices and provide cost benefits to the City. Leasing will continue under contract No. 26089 as required by Sharp.
This matter was reviewed by Deputy City Attorney Amy R. Burton on August 4, 2008 and Budget Management Officer Victoria Bell on July 29, 2008.
TIMING CONSIDERATIONS
City Council action is requested on August 19, 2008, to ensure that payments for the purchase, lease, maintenance and supplies for the Sharp Electronics Corporation multifunction devices are issued in a timely manner.
FISCAL IMPACT
The annual cost of this contract is $700,000, including tax, and is budgeted in various departments. The City will have the option of adding expenditures up to 10 percent (or $70,000) annually, if necessary and if funds are available.
