DISCUSSION
Pursuant to Administrative Regulation 23-3, the Department of Parks, Recreation and Marine (PRM) is requesting an Exception to Policy for approval to enter into an agreement with CH2M Hill (Hill) in an amount not to exceed $462,295, to provide final design services for the DeForest Wetlands Restoration Project.
 
In 2004, through California Coastal Conservancy (Conservancy) grant funding, Hill was hired by Los Angeles County Department of Public Works (LACDPW) to create the engineering design for both the DeForest Wetlands Restoration Project and the Dominguez Gap Project in floodwater detention basins along the Los Angeles River. LACDPW selected Hill at that time through a competitive selection process. Hill completed the design and construction drawings for the Dominguez Gap Project, but only completed the design for the DeForest Wetlands Restoration Project to the 30 percent level. LACDPW subsequently asked the City to take over the project, transferring remaining Conservancy funds to the City. On June 10, 2008, the City Council accepted the assignment of remaining Conservancy funding in the amount of $217,593 for the DeForest Wetlands Restoration Project.
 
In September 2008, Hill submitted a new proposal to the City for design services in the amount of $462,295, which exceeded appropriated funding. On December 9,2008, the City Council approved a recommendation to accept $2,500,000 in Los Angeles County Proposition A Grant funding, with $244,702 of the funds appropriated to fully fund Hill's recent proposal of $462,295.
 
Additional funding for the DeForest Wetlands Restoration Project has been requested from the California Resources Agency under the River Parkways Grant Program. In order for this grant application to be competitive, the City must be able to demonstrate that the project design is in progress.
 
This matter was reviewed by Deputy City Attorney Gary J. Anderson on December 1, 2008, and Budget Management Officer Victoria Bell on December 1, 2008.
 
TIMING CONSIDERATIONS
California Coastal Conservancy funding will expire in December 2009. City Council action is requested on December 16, 2008, in order to complete the design work prior to this deadline.
 
FISCAL IMPACT
Funding to complete the design phase of the DeForest Wetlands Restoration Project is appropriated in the Capital Projects Fund (CP) in the Department of Parks, Recreation and Marine (PR). There is no impact to the General Fund.
