TITLE
Recommendation to adopt Plans and Specifications No. R-6845 for The Toledo Undergrounding Project; award the project to and subject to the closing of the bond sale for City of Long Beach Assessment District No. 08-01; and authorize City Manager to execute a contract with the Hood Corporation in an amount not to exceed $744,200, and execute any necessary amendments thereto.  (District 3)
 
DISCUSSION
The owners of property along The Toledo between Second Street and the Geneva Walkway requested that the City establish an assessment district to finance the costs of undergrounding overhead electrical, telephone and cable facilities. In response, on September 23, 2008, the City Council adopted RES-08-116 expressing the intention of the City Council to establish City of Long Beach Assessment District No. 08-01. On November 11, 2008, after conducting a public hearing regarding the Assessment District, an election was held wherein 76 percent of the ballots cast by the owners of the property to be assessed (weighted by the amounts of the proposed assessments on their respective properties) voted in favor of the Assessment District.
 
On December 16, 2008, the City Council adopted RES-08-0158 overruling protests against the Assessment District and affirming the results of the election, and adopted RES-08-0159 confirming the assessments and ordering the improvements for the Assessment District. On December 22, 2008, the City Clerk recorded, in the County Recorder's Office, a Notice of Assessment against each of the parcels in the Assessment District. On May 18, 2010, City Council adopted two resolutions determining all unpaid assessments for the City's Assessment District No. 08-01, providing for the issuance of improvement bonds, and approving related documents and actions for Assessment District No. 08-01. Attached is a copy of the May 18, 2010 Council letter explaining the financing of this project in greater detail.
 
Based on plans prepared by the utility companies (Southern California Edison, Verizon Telephone and Charter Cable), the City prepared Plans and Specifications for the installation of conduit and other civil structures for bidding purposes. The project was advertised for bids on April 14,2010, and bids were opened on" May 12, 2010. In addition to placing an advertisement for bids in the Long Beach Press Telegram, bid documents were made available through the City's weblink at, http://www.PlanetBids.com. In a continuing effort to increase participation of local businesses and Small Business Enterprises (SBEs), Minority Business Enterprises (MBEs), Women Owned Business Enterprises (WBEs), and Disadvantaged Business Enterprises (DBEs), bid documents were also sent to several trade publications and plan rooms that support these groups within the construction industry.
 
For this bid, 1,013 firms were notified via automatic email notice, including 113 located in Long Beach. Notified firms consisted of 205 SBEs, 214 MBEs, 107 WBEs, and 70 DBEs registered firms. Twenty-six sets of bid documents were purchased by prospective bidders and 8 bids were received. Of those firms, none are local businesses or SBEs, three are MBEs, one is a WBE, and one MBE is also a DBEs.  The Hood Corporation, of Norco, California, is the lowest responsible bidder. This firm is not an SBE, MBE, WBE or DBE.
 
Prior to finalizing the contract for this project, the bond issuance financing this work must be completed. This is scheduled to occur on June 15, 2010. In accordance with the California Environmental Quality Act, Categorical Exemption number CE-110-08 has been issued for this project.
 
This matter was reviewed by Assistant City Attorney Heather A Mahood on May 14, 2010, and by Budget Management Officer Victoria Bell on May 17, 2010.
 
SUSTAINABILITY
 
All concrete work will include recycled waste ash, diverting these materials from our landfills.
 
TIMING CONSIDERATIONS
As stated above, the contract for the work will not be finalized until the proceeds of the improvement bonds, to be issued, have been received. In order to complete as much of the work as possible prior to the start of the school year, and thereby avoid disruption to the school site located in the Assessment District, the improvement work needs to begin as soon as possible.
 
FISCAL IMPACT
There is no fiscal impact to the City associated with the requested action. The costs of the improvement project will be paid solely from the prepaid assessments and the proceeds of the improvement bonds to be issued. All bond proceeds and revenue from for the Assessment District.  All expenses related to the formation of the Assessment District will be paid from the proceeds of improvement bonds to be issued, and annual administrative costs of the Assessment District will be paid from the administrative levy, to be included with the assessments that are annually levied on the parcels in the Assessment District. There are no local jobs impacted by this action.
