TITLE

Recommendation to authorize City Manager to execute any and all documents necessary for a Supplemental Agreement to Management Agreement No. 21667 with SMG, a Pennsylvania joint venture, for the completion of certain capital improvement projects for the Seaside Way Pedestrian Bridge and Connections at the Long Beach Convention and Entertainment Center located at 300 East Ocean Boulevard.  (District 2)

DISCUSSION

On December 2, 2013, the State Lands Commission approved proposed expenditures for projects throughout the Tidelands areas of Long Beach.  The State Lands Commission approval included HVAC, lobby area, restroom, entryway, food services, video systems and lighting improvement projects at the Center.  On June 16, 2015, the City Council approved the prioritization of the Tidelands Capital Improvement Projects and allocated $10,315,000 from Tidelands oil revenue for the Seaside Way Pedestrian Bridge and Connections at the Center, which included the following high priority capital project:

Seaside Way Lighting & Connector Project (approximately $300,000):

Of the total approved allocation, $300,000 is dedicated for this improved connection between the proposed bridge and Seaside Way.  This lighting enhancement project will provide lighting and visual improvements on Seaside Way between Hart and Collins Avenues directly below the Terrace Theater Plaza.  The project will include important safety improvements as well as delineating the area as a new streetscape and special event location.  The area outside the Seaside meeting rooms will have the ability to be activated as additional rentable event space for outdoor performances, vending/exhibit space, and table setup.  This project is a separate component of the Seaside Way Pedestrian Bridge Project, and will be managed by SMG.

This Supplemental Agreement is required to modify the Management Agreement to allow SMG to manage this capital improvement project.  SMG shall ensure that the bidding process for this project complies with City regulations and the resulting contracts comply with the State Labor Code, as well as with City’s insurance, bond and other performance requirements. SMG shall confirm with the City that the project is completed according to the terms of the given contract.

The proposed Supplemental Agreement provides only the authorization for SMG to contract for and administer the proposed capital improvements on behalf of the City of Long Beach.  No additional compensation is provided to SMG beyond that already provided under the existing Management Agreement.

This matter was reviewed by Deputy City Attorney Linda T. Vu on December 22, 2015 and by Budget Management Officer Victoria Bell on December 22, 2015.

TIMING CONSIDERATIONS

City Council action is requested on January 5, 2016, to allow SMG to immediately begin work to complete the project in a timely manner.

FISCAL IMPACT

The $300,000 for capital improvements at the Long Beach Convention and Entertainment Center is funded by Tidelands oil revenue, and is budgeted in the Tidelands Operations Fund (TF 401) in the City Manager Department (CM).  This expenditure of Tidelands oil revenue was approved by the California State Lands Commission on December 2, 2013.  Approval of this recommendation will provide continued support to the local economy.
