TITLE

DISCUSSION
In December 2011, Sinjin, LLC (Sinjin), which is owned and operated by former professional beach volleyball player Sinjin Smith, applied to be a beach volleyball contract class instructor within the Department of Parks, Recreation and Marine (PRM). PRM has identified a need for programming on the City's beach volleyball courts, and a Personal Services and Instruction Agreement (Proposed Agreement) is required to allow Sinjin to instruct on behalf of the City, as illustrated on the proposed contract class listing (Attachment).  Under the provisions of the Proposed Agreement, Sinjin would be a contract class instructor within PRM, and recreational contract classes for beach volleyball would be added to PRM's quarterly Recreation Connection.
 
PRM partners with contract class instructors to provide over 2,000 fee-based recreational classes to the public each year.  These classes are intended to provide educational and/or recreational opportunities for the public.  Contract class instructors are selected in an open application process, which is administered by PRM through its Contract Classes Division.  Contract class instructors are selected based upon their qualifications and experience, and the community need and/or demand for the subject matter.  Contract class instructors must satisfy all PRM requirements regarding reference verification and livescan background checks.
 
Pursuant to Title IX, Section 902.(c.) of the City Charter, issuance of Personal Services and Instruction Agreements have historically fallen under the purview of the Parks and Recreation Commission (Commission).  However, since the proposed recreational contract classes will be within the Tidelands, the Commission has no chartered authority to issue such agreements.  Therefore, City Council approval is required.
 
This matter was reviewed by Deputy City Attorney Gary J. Anderson and Budget Management Officer Victoria Bell on March 7, 2011.
 
TIMING CONSIDERATIONS
City Council action is requested on March 22, 2011, in order to enable the execution of all documents associated with the proposed Personal Services and Instruction Agreement, and to allow the Department of Parks, Recreation and Marine to add beach volleyball classes to its upcoming spring Recreation Connection.
 
FISCAL IMPACT
PRM will collect fees and process all enrollments for the proposed contract classes.  A $6 to $8 per enrollee fee will be retained by PRM to recover costs for promotion and administration.  The remaining net revenue will be shared between the City and Sinjin.  The City will receive 35 percent of the net revenue from the proposed contract classes, which will accrue to the Tidelands Operating Fund (TF 401) in the Department of Parks, Recreation and Marine (PR).  Since actual revenue cannot be projected at this time due to this being a new contract class, PRM will come back to City Council at a later date with an appropriation increase request for the remaining 65 percent of net revenue in order to facilitate payment to Sinjin, LLC, which is consistent with all other PRM Personal Services and Instruction Agreements.  Since Sinjin will be using its existing instructors to teach the proposed contract classes, there is no impact to jobs associated with the recommended action.
