DISCUSSION
The State Budget Act for Fiscal Year 2000-2001 resulted in $3,500,000 of grant funding being appropriated to the City for installing water pollution traps into storm drains within the City of Long Beach. To date this funding has been used for a Storm Drain Pollution Trap located at Hamilton Bowl ($600,000) and Storm Drain Pollution Trap Nets at various City owned pump stations ($1.9 million). Up to $1,000,000 remains to be used for catch basin inserts, which are designed to remove pollutants before they are discharged into receiving waters. The grant, which expires June 30, 2004, will fully fund the cost of installing catch basin inserts at designated locations and one year of monitoring.
 
Asbury Environmental Services (AES) distributes and installs a catch basin insert product called Ultra-Urban® Filters with Smart Sponge Plus® technology. These catch basin inserts are the only product of their kind to capture bacteria and pathogens in addition to trash, sediment, and hydrocarbons. AES is the only distributor in California for the UltraUrban® Filters with Smart Sponge Plus® technology, which is manufactured by Abtech Industries. Based on this, staff is recommending that the normal bidding process be waived through adoption of the attached resolution and a contract be awarded to Asbury for the installation of these catch basin inserts.
 
This matter was reviewed by Deputy City Attorney Lisa Peskay Malmsten on April 14, 2004, and Budget Manager Michael Killebrew on April 14, 2004.
 
...FISCAL IMPACT
 
The AES catch basin insert purchase, installation, and monitoring will not exceed $1,000,000. Sufficient funds to cover the expenditures are budgeted in PW7070 in the Capital Projects Fund (CP) in the Department of Public Works (PW).
 
IT IS RECOMMENDED THAT THE CITY COUNCIL:
Adopt the attached resolution, which waives the bidding process and authorizes the City Manager to execute a contract with Asbury Environmental Services in an amount not to exceed $1,000,000 for the purchase and installation of Ultra-Urban® Filters with Smart Sponge Plus® technology and one year of monitoring.
 
...TIMING CONSIDERATIONS
City Council action on this matter is requested May 4, 2004, in order to meet the grant deadline.
