TITLE

Recommendation to authorize City Manager to execute the Second Amendment to Contract No. 29041 with Damon Construction, Inc., for the annual contract for sidewalk repairs, curb ramps and related improvements, extending the term of the contract to December 31, 2007; and increasing the contract by $4,000,000 for a total amount of $11,000,000.  (Citywide)

 

DISCUSSION

The City Council awarded the annual contract to Damon Construction, Inc., on December 7, 2004, and authorized the First Amendment for the extension of term on November 15, 2005, for repair of the City's sidewalks, curb ramps and other related improvements (attached as Exhibit A and B, respectively). The contract provides for an "on-call" arrangement, whereby the contractor provides the City with fixed unit prices for the repair of sidewalks, curbs, gutters, driveway approaches, alleys and curb ramps.

The City issues work orders to the contractor for specific work at various locations.

Upon the successful completion of a work order, additional work orders are assigned until all available funding for this type of work has been depleted.

 

City Council action on December 7, 2004, authorized the extension of the contract for up to two additional one-year terms. Since contract award, the contractor's performance has been of good quality. All assigned work orders have been completed in a timely manner with few complaints. This annual contract provides for an expedient means of constructing sidewalks, curb ramps, alleys and other related concrete work and will be used by the Departments of Public Works, Community Development and Parks, Recreation and Marine. Based upon the acceptable performance by the contractor and the contractor's agreement to comply with Section 3 requirements of the Community Development Block Grant Funding, staff is recommending exercising the City's option to extend the contract for an additional one-year period and increase the contract by $4,000,000, for a total contract amount of $11,000,000.

 

The requested contract amount will allow for completion of the FY 07 sidewalk program, as well as curb and gutter repair in the street repair program and Redevelopment projects in North Long Beach.

 

This matter was reviewed by Senior Deputy City Attorney Donna F. Gwin on November 1, 2006, and by Budget Management Officer David Wodynski on November 3, 2006.

 

TIMING CONSIDERATIONS

City Council action is requested on November 14, 2006, to allow on-going sidewalk repair projects to proceed without interruption.

 

FISCAL IMPACT

The contract amendment is for an estimated amount of $4,000,000. Individual purchase orders issued under this contract will be funded by the department issuing the purchase order within current appropriations including, but not limited to, the Capital Projects Fund (CP). No appropriation increases are required.
