Increase appropriations in the Capital Projects Fund Group in the Public Works Department by $1,722,000, offset by Federal Highway Funds from Caltrans (STPL-5108(183)), approved by the Los Angeles County Metropolitan Transportation Authority (Metro);

 

Increase appropriations in the Capital Projects Fund Group in the Public Works Department by $1,722,000, offset by transfer of Federal Highway Funds from the Capital Projects Grant Fund; and

DISCUSSION

City Council approval is requested to enter into a contract with C.S. Legacy Construction, Inc., for the construction of the Long Beach Boulevard Pedestrian Improvements Project (Project).

 

On January 16, 2007, the City Council authorized staff to apply for grant Caltrans Federal Highway funding for the Project under the Los Angeles County Metropolitan Transportation Authority’s (Metro) 2007 Call for Projects. A grant for the project, in the amount of $ 1,722,000, was subsequently approved by the Metro Board of Directors on September 27, 2007. On January 25, 2010, the Metro Board of Directors executed the Funding Agreement for the Project. Since 2010, the Public Works Department has been coordinating with multiple agencies through planning, permitting, design, and formal approval processes so construction on the Project can begin.  During this time, staff have also been working to set aside the additional required funding needed to complete the Project while also delivering other priority projects.

 

The Project provides pedestrian-oriented improvements to Long Beach Boulevard, including pedestrian lighting, median and parkway landscape and hardscape, signage, and striped crosswalk treatments between 27th Street and 31st Street.

 

The bid was advertised in the Long Beach Press-Telegram on January 13, 2020, and 194 potential bidders specializing in construction services were notified of the bid opportunity. Of those bidders, 71 downloaded the bid via the City’s electronic bid system. The bid document was made available from the Purchasing Division website at www.longbeach.gov/purchasing <http://www.longbeach.gov/purchasing>. A bid announcement was also included in the Purchasing’s weekly update of Open Bid Opportunities, which is sent to 35 local, minority-owned and women-owned business groups. Six bids were received on March 25, 2020. Of those six bidders, one was Minority-owned Business Enterprise (MBE), none were Women-owned Business Enterprises (WBEs), one was a certified Small Business Enterprise (SBE), and none were a Long Beach businesses (Local). C.S. Legacy Construction, Inc., of Ontario, CA (not a MBE, WBE, SBE, or Local), was the lowest responsible and responsive bidder.

 

After bid opening, but prior to the scheduled award, the City went into the COVID-19 pandemic response.  During this time, some projects were temporarily impacted.  This project is now ready to proceed to award. The contractor is willing to honor the original bid price.

 

Local Business Outreach

 

To align with the City’s outreach goal, Long Beach businesses are encouraged to submit bids for City contracts. The Purchasing Division also assists businesses with registering on the PlanetBids database to download bid specifications. Through outreach, 34 Long Beach vendors were notified to submit bids, of which none downloaded or submitted a bid. The Purchasing Division is committed to continuing to perform outreach to local vendors to expand the bidder pool.

 

This matter was reviewed by Deputy City Attorney Amy R. Webber on April 20, 2021, Business Services Bureau Manager Tara Mortensen on April 21, 2021, and by Budget Management Officer Rhutu Amin Gharib on April 28, 2021.

 

SUSTAINABILITY/ENVIRONMENTAL

 

The proposed improvements would make Long Beach Boulevard more accessible to pedestrians and the surrounding neighborhood residents, thus potentially resulting in less vehicle usage and a reduction of air pollution harmful to the environment as part of the State Active Transportation Program (ATP).

 

In conformance with the California Environmental Quality Act (CEQA), Categorical Exemption No. CE-21-040 was issued for this project (Attachment A).

                         

TIMING CONSIDERATIONS

City Council action to adopt Plans and Specifications No. R-7163 and award a contract concurrently is requested on May 11, 2021, to allow the project to proceed. 

 

FISCAL IMPACT

The total cost of the Project is estimated at $3,337,323 and includes the contract award amount of $2,859,852, inclusive of a 15 percent contingency, and the cost for design, construction management, labor compliance, and project oversight. The total project cost is supported by $1,722,000 from Federal Highway Funding from Caltrans approved by Metro, $1,849 from General Capital, $298,650 from Measure R, $344,000 from Proposition A, and $970,824 from Proposition C. The Federal grant requires a local match of $477,244 for construction, which is comprised of the sources listed above and is budgeted in the Capital Projects Fund Group in the Public Works Department.

 

An appropriation increase of $3,444,000 is requested in the Capital Projects Fund Group in the Public Works Department.  Of this amount, $1,722,000 will be offset with Federal grant fund reimbursement from Caltrans.  The remaining $1,722,000 is a technical appropriation to allow for the transfer of federal grant funds from the Capital Projects Grant Fund, a fund within the Capital Projects Fund Group. This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities. Approval of this recommendation will provide continued support to our local economy. The number of additional local jobs created by the Project will not be known until the contractor completes their hiring and construction has commenced.
