TITLE
Recommendation to authorize City Manager to execute agreements for as-needed certified materials testing and inspection, and construction management services for Public Works infrastructure and facility projects with Kleinfelder West, Inc., Smith Emery Laboratories, Psomas, Totum Corp., and Willdan in an amount not to exceed $1,750,000 per consultant for a three-year term; and
Authorize City Manager to execute subsequent amendments to the agreements, relative to extending the term for up to two additional one-year terms and increasing the agreement amount, authorize additional services, if required, within the provisions of the agreements, and adjust the fee schedule of hourly and line item rates for inflation. DISCUSSION
The City of Long Beach has historically used professional consultants on an as-needed basis to provide certified materials testing and inspection for capital projects related to facility, building and infrastructure improvements. These as-needed services include but are not limited to concrete, masonry, aggregates, asphalt, soils metals, fireproofing, environmental sampling and testing in accordance with Environmental Protection Agency (EPA) standards and other general laboratory materials tests and quality control that require inspectors certified for these specialties. Additionally, as-needed inspection by professional special deputy inspectors for City facilities are required by building codes. Construction management agreements are required to manage projects from inception until completion.
These agreements are needed in order to secure several certified materials testing and inspection firms and construction management firms, with expertise unique for projects in programs in the Department of Public Works. Given the limited overall human resources within the Department and the lack of certain specialized expertise, these consulting services are presently needed in order to undertake and complete the current and future program of projects within the Department. Current as-needed consultant contracts related to these specialized fields have expired or will expire shortly. In anticipation of this, a Request for Proposal (RFP) process was conducted in accordance with Administrative Regulation 8-4, "Selecting Professional Consultants," to secure these needed professional services.
A host of consulting firms, led by 15 prime consulting firms, submitted formal written proposals. The consultants and subconsultants altogether included two local Long Beach firms. A multi-departmental Technical Evaluation Committee reviewed the proposals, interviewed a short-listed portion of the aforementioned respondents and selected the following five firms to provide the scope of professional services based on each firm's proposal, oral interview, qualifications, experience, references and range of services:

· Smith Emery Laboratories
· Psomas Totum Corp.
· Willdan
Including their subconsultants, these recommended firms include one local Long Beach firm. As individual projects are identified, Public Works will issue work orders to the various firms. Each work order will be funded from the source identified for each particular project.
This matter was reviewed by Deputy City Attorney Amy Burton on August 24,2007, and Budget and Performance Management Bureau Manager David Wodynski on August 24, 2007.
TIMING CONSIDERATIONS
City Council approval is requested on September 4, 2007, to allow a continued timely output of Capital Improvement Projects.
FISCAL IMPACT
The five contract awards are for a maximum amount of $1,750,000 each, for an aggregate maximum total not to exceed $8,750,000 during a three-year term of the contracts. Sufficient funds to cover these costs are, or will be, included in various capital improvement project budgets in the Capital Projects Fund (CP). No appropriation increase is required.
