TITLE
Recommendation to adopt Plans and Specifications No. R-6979 for the Improvements of Magnolia Avenue, between Ocean Boulevard and 4th Street; award the contract to Ruiz Concrete & Paving, of Long Beach, CA, for the base bid in the amount of $356,169, and authorize a 15 percent contingency in the amount of $53,425, for a total contract amount not to exceed $409,594; and authorize City Manager or designee to execute all documents necessary to enter into the contract, including any necessary amendments thereto.  (Districts 1,2)
 
DISCUSSION
City Council approval is requested to enter into a contract with Ruiz Concrete & Paving.  The street infrastructure on Magnolia Avenue, between Ocean Boulevard and 4th Street, is in need of rehabilitation.  Improvements include sections between Ocean Boulevard to Broadway and 3rd Street to 4th Street.  The rehabilitation work consists of replacing damaged curbs and gutters, driveways, alley entrances, sidewalk and the trimming or shaving of tree roots; reconstructing areas of deteriorated pavement; cold milling and resurfacing the pavement; ADA compliance improvements; installing a bus pad, traffic striping, markings, and markers; traffic control; water quality best management practices; and related improvements.  The section between Broadway and 3rd Street was recently completed as part of the Deukmejian Courthouse off-site improvements.  A vicinity map showing the project location is attached.  
 
This project was advertised in the Press-Telegram on May 16, 2014, and 2,805 potential bidders, specializing in construction, were notified of the bid opportunity.  Of those bidders, 61 sets of bid documents were purchased or downloaded via the electronic bid system.  The bid document was made available from the Purchasing Division, located on the seventh floor of City Hall, the Division's website at www.longbeach.gov/purchasing <http://www.longbeach.gov/purchasing>, and was also sent to several trade publications and plan rooms catering to these groups within the construction industry.  A bid announcement was also included in the Purchasing Division's weekly update of Open Bid Opportunities, which is sent to 30 local, minority and women-owned business groups.  Seven bids were received on June 18, 2014.  Of those seven bidders, two were Minority-owned Business Enterprises (MBE), none were Women-owned Business Enterprises (WBEs), one was a certified Small Business Enterprise (SBE), none were Disadvantaged Business Enterprises (DBEs), and two were Long Beach businesses (Local).  Ruiz Concrete & Paving, of Long Beach, CA (Local and MBE, not a WBE, DBE or SBE), was the lowest responsible bidder.
 
Local Business Outreach
 
In an effort to align with our outreach goal, Long Beach businesses are encouraged to submit bids for City contracts.  The Purchasing Division also assists businesses with registering on the Bids Online database to download bid specifications.  Through outreach, 269 Long Beach vendors were notified to submit bids, of which five downloaded and two submitted a bid.  The Purchasing Division is committed to continuing to perform outreach to local vendors to expand the bidder pool.
 
This matter was reviewed by Deputy City Attorney Amy R. Webber August 7, 2014 and by Budget Management Officer Victoria Bell on August 18, 2014.
 
SUSTAINABILITY
 
The old asphalt material to be removed under this contract (690 tons) will be recycled into new asphalt concrete, or utilized as base material on other street projects.  The street will be resurfaced with asphalt containing up to 15 percent recycled material.  Finally, 650 tons of road base made from recycled concrete, rock, sand and asphalt will be utilized in this project and all concrete work will include recycled waste ash, diverting these materials from our landfills.
 
In accordance with the California Environmental Quality Act (CEQA), this project has been determined to be statutorily exempt.   
 
TIMING CONSIDERATIONS
City Council action on this matter is requested on September 2, 2014 to allow commencement of this Public Works project.
 
FISCAL IMPACT
The total contract award amount is not to exceed $409,594, including a recommended 15 percent contingency of $53,425 due to the potential for unforeseen circumstances.  Sufficient funds are budgeted in the Gas Tax Street Improvement Fund (SR 181) in the Public Works Department (PW). The award of this contract will provide continued support to our local economy by assisting in the preservation of employment for 13 full-time employees residing in Long Beach.
