TITLE
Recommendation to authorize City Manager to execute a first amendment to Agreement No. 29516 to increase the contract, in an amount not to exceed $59,000, with Mr. Larry Curtis to provide services as Conductor/Director of the Long Beach Municipal Band for a one-year term, ending December 31, 2007. (Districts 2,3,4,5,8)
DISCUSSION
On February 21, 2006, the City Council authorized the execution of an agreement with Mr. Larry Curtis to provide services as Conductor/Director of the Long Beach Municipal Band (Municipal Band) in an amount not to exceed $54,000. Mr. Curtis has served as the Conductor/Director for the Municipal Band for more than a decade. It has been six years since Mr. Curtis has received an increase in his contracted amount. In light of this fact, Mr. Curtis approached the Department of Parks, Recreation and Marine (PRM) to request a rate adjustment. The proposed adjustment is in the amount of $5,000, for a new total not to exceed $59,000. This amount represents a 10 percent increase. The Department of Parks, Recreation and Marine supports the request for an increase.

This matter was reviewed by Deputy City Attorney Gary J. Anderson on March 15, 2007, and Budget and Performance Management Bureau Manager David Wodynski on March 14, 2007.
TIMING CONSIDERATIONS
City Council action is requested on April 3, 2007, to allow timely execution of the agreement and pre-season concert activities.
FISCAL IMPACT
The proposed amendment to Agreement No. 29516 with Mr. Larry Curtis is for an amount not to exceed $59,000 per year. Sufficient appropriation to support the Municipal Band in Fiscal Year 2007 is included in the Tidelands Operating Fund (TF) and the Special Advertising and Promotions Fund (SR 133) in the Department of Parks, Recreation and Marine (PR).
