TITLE
Recommendation to authorize City Manager to execute a buildover agreement with County Sanitation District No. 2 of Los Angeles County, in conjunction with the expansion of Admiral Kidd Park.  (District 7)
 
DISCUSSION
Plans for the expansion of Admiral Kidd Park include the vacation of a portion of 21st Street, west of Santa Fe Avenue. The vacation of this portion of 21st Street provides the opportunity for the expansion parcels (the "Green Monster" site south of 21 st Street) to become wholly integrated with the existing park. However, this portion of the street includes an easement with County Sanitation District No. 2 of Los Angeles County, (District) for a trunk sewer line. Once the park expansion is complete, the sewer easement and associated District utilities will be within park boundaries. Therefore, the District is requiring that the City of Long Beach (City) enter into a buildover agreement (Agreement) with the District.
 
The proposed Agreement contains the following major provisions:
 
·      Proposed Improvements: The District shall review and approve improvements to the park that are related to the District easement and facilities. The City shall construct a minimum 12-foot wide driveway, per the Districts' specifications, in order to perform routine maintenance, and to provide access to District facilities in emergency situations.
 
·      Term: The Agreement constitutes a covenant running with the land and will remain in place as long as the District facilities are in place and the easement is required.
 
·      Fees: No fees will be charged for the execution of the Agreement. The District shall record the Agreement.
 
This matter was reviewed by Deputy City Attorney Gary J. Anderson on June 4, 2010, and Budget Management Officer Victoria Bell on June 11, 2010.
 
TIMING CONSIDERATIONS
City Council action is requested on July 6, 2010, in order to enable the execution of a buildover agreement as part of the ongoing expansion of Admiral Kidd Park.
 
FISCAL IMPACT
There is no fiscal impact associated with this request. There is no impact to jobs associated with this request.
