TITLE
Recommendation to adopt resolution authorizing City Manager, or designee, to submit a grant application to the California Ocean Protection Council (OPC), for the Long Beach Municipal Urban Stormwater Treatment Recycle Facility; accept said grant, if awarded, in an amount up to $2,000,000 in Proposition 1 funding through OPC grant funds; and, execute all documents necessary to accept the funds. (Districts 1,7,8,9)
DISCUSSION
In November 2014, voters passed the Water Quality, Supply, and Infrastructure Improvement Act of 2014 (Prop 1), codified as Division 26.7 of the Water Code. Prop 1 authorizes $7.5 billion in general obligation bonds for State water projects, including surface and groundwater storage, ecosystem and watershed protection and restoration, and drinking water protection. Prop 1 Chapter 6, “Protecting Rivers, Lakes, Streams, Coastal Waters, and Watersheds,” allocated $30 million to the California Ocean Protection Council (OPC) for a competitive grant program for multi-benefit ecosystem and watershed protection and restoration projects.
Prop 1 Ocean Protection Council (Prop 1 OPC) Round 3 is an open call for grant applications from January 28, 2019 through March 18, 2019, with $10,000,000 available this round and a maximum award amount of $2,000,000. OPC encourages applications for wetland and other habitat restoration projects, such as those typically funded through Prop 1, that provide a long-term benefit to the public and address at least one of the following priority issues: marine managed areas, ocean and coastal water quality impacts, fisheries and fish habitat, or climate change adaptation. The Long Beach Municipal Urban Stormwater Treatment (LB-MUST) project (Project) meets the guidelines of the Prop 1 OPC Round 3 grant program. City Council approval is requested to apply for $2,000,000 in Prop 1 OPC grant funds. If awarded, the funds will be used to cover the funding shortfall associated with the additional scope of work and costs associated with the design and construction of the project.

TIMING CONSIDERATIONS
City Council action is requested on March 12, 2019, to ensure the grant application is submitted by the grant deadline. A Resolution authorizing submittal of the application is required in the application package.
FISCAL IMPACT
The total estimated project cost of the LB-MUST is $62,000,000, which includes design, construction, construction management, inspection, labor compliance, and project oversight. The total cost is supported by $28,000,000 from the California Department of Transportation grant funding, $2,000,000 in grant funding from the Rivers and Mountains Conservancy, and $428,000 from City Capital Projects funds.
No appropriation is requested at this time. Upon grant award, staff will return to the City Council with a request for appropriation, offset by grant revenue. The grant will have a dollar per dollar match requirement. Sufficient matching funds are currently appropriated in the Capital Projects Fund (CP) in the Public Works Department (PW) to meet the grant match requirements. Compiling of this report is expected to have minimal impact on staff hours and existing City Council priorities beyond the budgeted scope of duties. There is no local job impact associated with this recommendation.
