TITLE
Recommendation to adopt resolution and authorize City Manager to execute all necessary documents to receive and expend funding from the City of Gardena, acting on behalf of the State of California Board of State and Community Corrections (BSCC), and increase appropriations in the General Grants Fund (SR 120) in the Police Department (PD) by $595,566. (Citywide)
DISCUSSION
In 2011, Governor Edmund G. Brown, Jr., signed Assembly Bill (AB) 109 and AB 117, to reduce the number of inmates in State prison. Commonly known as "Realignment," this legislation required structural changes to the corrections system in the State of California. As part of this legislation, AB 109 provides a dedicated and permanent revenue stream to the counties through Vehicle License Fees and a portion of the State sales tax. In November 2012, California voters passed Governor Brown's Proposition 30, which created a constitutional amendment prohibiting the Legislature from reducing or removing Realignment funding to the counties.
In the 2014 Budget Act, Governor Brown approved $27.5 million to be shared among local government agencies statewide in an effort to assist with funding compliance checks conducted by local police. The City of Long Beach was allocated $595,566 of this amount based on population. Monies received will be used for straight time and overtime, investigative work and training to identify and prioritize compliance checks on local probationers.
This matter was reviewed by Deputy City Attorney Kendra Carney on April 28, 2014 and by Budget Officer Victoria Bell on May 1, 2014.
TIMING CONSIDERATIONS
City Council action on this matter is requested at the May 20, 2014 meeting in order to continue conducting compliance checks throughout the City.
FISCAL IMPACT
As the compliance check program is currently unbudgeted, an appropriation increase in the General Grants Fund (SR 120) in the Police Department (PD) in the amount of $595,566 is recommended. Once approved by the City Council, the City of Gardena, serving as the fiduciary agent on behalf of State of California, will disburse the funds. Revenue provided from the State will offset the expense appropriation and no matching funds are required. There is no local job impact associated with this recommendation.
