Recommendation to receive and file annual report of the activities of the Board of Examiners, Appeals and Condemnation for fiscal year
2003-04, in accordance with Long Beach Municipal Code Section
2.18.090. (Citywide)
DISCUSSION
The Board of Examiners, Appeals and Condemnation was established pursuant to Long Beach Municipal Code Section 18.20.090. This board acts as a forum for reviewing the determinations of the Building Official/Superintendent of Building and Safety, relating to alternate materials and types of construction, substandard conditions of buildings and properties, and abatement of nuisances. The Board operations are essential to the efficient, effective and equitable administration of the City building laws and should be continued.
There were eleven meetings held in fiscal year 2003-04. The attendance record of the board members are attached and the hearings conducted were as follow:

In fiscal year 2UU4-U5 it is projected that the number of cases being referred to the Board will reduce as a result of the Code Enforcement Study, which consolidated the Code Enforcement programs and created the Administrative Citation program. Through the consolidation, many of the property maintenance and less significant substandard cases, which were referred to the Board for a public hearing, are being handled administratively through the City Prosecutors Office. The Board, however, has agreed to serve as the Hearing Officer for the Administrative Citation program. The final impact on the Board will not be known until all ordinances and policies are in place for the full implementation of the Code Enforcement consolidation.

FISCAL IMPACT
The staff personnel who regularly attend the meetings of the Board are the:
Superintendent of Building and Safety acting as Secretary to the Board; Neighborhood Services Bureau Manager and Building Inspection Officer in charge of the Housing/Conservation Section; Chief Building Inspector; subordinate code enforcement staff; and a secretary to take minutes.
