TITLE

Recommendation to adopt resolution approving the Long Beach Supervisors Employees Association Agency Shop Agreement, and authorize City Manager to execute the Agreement.  (Citywide)

 

DISCUSSION

On July 15, 2016, the Skilled and General Supervisory Bargaining Unit voted to be recognized as an employee association, now known as the Long Beach Supervisors Employees Association (LBSEA).  The LBSEA has submitted majority support petitions to become an Agency Shop and, in accordance with the Meyers-Milias-Brown Act (MMBA), the City negotiated with LBSEA to develop the attached Agency Shop Agreement (Attachment A of the Resolution).  An Agency Shop agreement requires that all bargaining unit employees pay a fee (“service” fee) covering the cost of representation to the employee organization.

 

Pursuant to MMBA, in order for the City to implement Agency Shop it is necessary for the City Council to adopt a Resolution as prepared by the City Attorney’s Office.  Pending approval of the Resolution by the City Council, effective September 17, 2016, employees who are represented by the LBSEA, who are not paying membership dues, will begin paying Agency Shop fees as a condition of employment. The monthly Agency Shop fee is $29 for full-time employees and $14 for part-time employees.

 

This matter was reviewed by Principal Deputy City Attorney Gary Anderson on August 24, 2016 and by Assistant Finance Director Lea Eriksen on August 19, 2016.

 

TIMING CONSIDERATIONS

City Council action is requested on September 13, 2016, to ensure implementation of the Agency Shop provisions for processing consistent with the effective date of September 17, 2016.

 

FISCAL IMPACT

There is no fiscal impact to the General Fund.  The proposed Agency Shop fees are paid by employees. There is no local job impact associated with this recommendation.
