TITLE
Recommendation to adopt resolution authorizing City Manager to execute a contract with Consolidated Fabricators Corporation of Vernon, CA (not an MBE, WBE, SBE or Local), for the purchase of commercial trash containers on the same terms and conditions afforded to the Los Angeles Community College District, in the estimated annual amount of $95,000 for the period of one year, with the option of renewing for two additional one-year periods, at the discretion of the City Manager, if necessary and if funds are available.  (Citywide)
 
DISCUSSION
City Council approval is being requested authorizing the City Manager to execute a contract for the purchase of commercial trash containers (up to 8-cubic yards), to support the Department of Public Works' ongoing commercial and residential refuse maintenance program. The Department of Public Works, Environmental Services Bureau, is requesting to purchase containers to replace the City's current 300-gallon trash containers that are over ten years old and are being phased out.  Replacing the current 300-gallon trash containers will minimize overflow of trash and take up less space in alleys.  Also, replacing current 2-cubic yard trash containers with larger containers, as needed, will reduce collections and thus reduce heavy-duty vehicle traffic in alleys.
 
The City Charter provides an alternative procurement method by permitting the City to purchase or otherwise obtain services, supplies, materials, equipment and labor with other governmental agencies by purchasing under their contracts on a voluntary and selective basis when authorized by a Resolution of the City Council.
 
The Department of Public Works, Environmental Services Bureau, investigated procurement options and learned that the Los Angeles Community College District had completed a competitive bid process in April 2009. The bid was awarded to Consolidated Fabricators Corporation. The Environmental Services Bureau purchased its current commercial trash containers through Consolidated Fabricators Corporation and is pleased with their products and service.  This cooperative purchase agreement will facilitate the continuous acquisition of the trash containers and provide cost benefits to the City.
 
This matter was reviewed by Deputy City Attorney Amy R. Burton on October 21, 2010 and Budget Management Officer Victoria Bell on October 22, 2010.
 
SUSTAINABILITY
 
In keeping with the City's Green Purchasing Policy, we ask contractors to provide products that are environmentally-friendly, organic, plant-based, and refillable or reusable when applicable.  The Economic benefit to reduce the City's carbon footprint and wear on the City's infrastructure, with the larger, more efficient dumpster, is a reduced service schedule that will mean fewer truck trips.   The entire bin itself is recyclable after its lifespan.
 
TIMING CONSIDERATIONS
City Council action to adopt the attached Resolution is requested on November 16, 2010 to ensure that the contract is in place to minimize delays in delivery turnaround time.
 
FISCAL IMPACT
The estimated annual cost of this contract is $95,000, which is budgeted in the Refuse/Recycling Enterprise Fund (EF 330) in the Department of Public Works (PW).  This Resolution will provide continued support to our local economy by assisting in the preservation of six full-time employees residing in Long Beach with employment.
