DISCUSSION
As part of the American Recovery and Reinvestment Act of 2009 (ARRA), the City of Long Beach (City) received $3,202,977 in funding support through the California State Water Resources Control Board (SWRCB) for the Colorado Lagoon Restoration Project.
 
The anticipated construction work at the Lagoon will consist of a low-flow diversion system, trash separation devices, and the cleaning of the underground culvert that connects the Colorado Lagoon to Marine Stadium. A vicinity map of the area is attached as Exhibit A.
 
City Council's adoption of the plans and specifications and award of the contract to the lowest responsible bidder are being recommended concurrently in order to expedite implementation of this project. The project was advertised for bids on September 25, 2009, and bids were opened on November 11, 2009. Of the thirty-eight Plans and Specifications that were sold, none were from a local business. Information regarding the selected bidder, ARB Inc., is provided in the contract award document, attached as Exhibit B.
 
This matter was reviewed by Linda Trang, Deputy City Attorney, on December 3, 2009, and by David Wodynski, Budget and Performance Management Bureau Manager, on December 3, 2009.
 
SUSTAINABILITY
 
The project will benefit the Colorado Lagoon by improving water quality and reducing the amount of trash that discharges into the lagoon through the storm drains. Wetland habitat will also be improved through the culvert cleaning.
 
TIMING CONSIDERATIONS
City Council action on this matter is critical in order to meet funding guidelines to issue a Notice to Proceed by December 31, 2009. Actual construction work is anticipated to begin in April 2010 and should take approximately 120 working days.
 
FISCAL IMPACT
The contract award is for an estimated amount of $3,787,238, plus a 20 percent contingency of $757,448, if necessary, and if the funds are available, for a total of $4,544,686. Total project costs are estimated to be $5,384,048, of which $2,967,917 is currently appropriated in the Tidelands Operation Fund (TF) in the Department of Community Development (CD). Remaining funding will be provided by a Port of Long Beach advance of $1,300,000 in anticipation of approval for project mitigation credits, and $1,116,131 from the SWRCB. The recommendation includes an appropriation increase in the Tidelands Operation Fund (TF) in the Department of Community Development (CD) for $2,416,131 to utilize these funds. If the mitigation credits are not approved by the State and Federal resource agencies, staff will return to the City Council with an alternative financing plan.
