TITLE
Recommendation to authorize City Manager, or designee, to execute all documents necessary to amend Contract No. 35929 with C.S. Legacy Construction, Inc., of Chico, CA, for the construction of Long Beach Boulevard Pedestrian Improvements, to increase the contract amount by $463,062, with a 15 percent contingency in the amount of $69,459, for a revised contract amount not to exceed $3,392,373. (Districts 6,7)
DISCUSSION
City Council approval is requested to amend Contract No. 35929 with C.S. Legacy Construction, Inc. (C.S. Legacy Construction), to complete the construction of Long Beach Boulevard Pedestrian Improvements.
On May 11, 2021, the City Council awarded the contract to C.S. Legacy Construction for the construction of the Long Beach Boulevard Pedestrian Improvements Project (Project) under Plans and Specifications R-7163 in the amount of $2,486,828, with a 15 percent contingency in the amount of $373,024, for a total contract amount not to exceed $2,859,852.
During the course of construction there were multiple unforeseen conditions encountered consisting of unknown conflicting utilities requiring design modifications, unknown roadway material under median islands requiring additional removals and import for median landscaping and irrigation, and the excessive deterioration of existing electrical conduit requiring the installation of all new conduit throughout the Project. As a result of these unforeseen conditions, amongst others, the Project will exceed the original contract amount and contingency.
This matter was reviewed by Deputy City Attorney Erin Weesner-McKinley on April 11, 2022, Purchasing Agent Michelle Wilson on April 13, 2022, and by Budget Management Officer Nader Kaamoush on April 20, 2022.
TIMING CONSIDERATIONS
City Council action to amend Contract No. 35929 is requested on May 10, 2022, to ensure timely completion of the Project.
FISCAL IMPACT
The requested action increases the contract authority with C.S. Legacy by $532,521, inclusive of a 15 percent contingency, for an amended contract amount not exceed $3,392,373. The total cost of the Project is estimated at $3,833,179 and includes the contract and contingency amount of $3,392,373, design, construction management, labor compliance, and project oversight. The total project cost is supported by $970,824 Proposition C funds, $344,000 Proposition A funds, $794,506 Measure R funds, $1,722,000 Federal Highway funding awarded through Metro, and $1,849 General Capital funds. Sufficient appropriations exist in the Capital Project Fund Group in the Department of Public Works to support the requested increase. This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities. There is no local job impact associated with this recommendation.
