TITLE
Recommendation to authorize City Manager to execute a Revocable Permit with the Los Angeles County Flood Control District for the use of vacant City-owned property along the west bank of the Los Angeles River, south of Ocean Boulevard, for one dollar per year, for a period of ten years.  (District 2)
 
DISCUSSION
On August 24, 1999, the City Council approved Revocable Permit No. 26527 with the Los Angeles County Department of Public Works (LACDPW) for the use of 38,880 square feet of vacant City-owned land on the west bank of the Los Angeles River (River), south of Ocean Boulevard (Exhibit A - Site Map) for a fee of one dollar per year.  The property has been used for the temporary storage of trash and semi-submerged debris pulled from the River that might otherwise enter the ocean and compromise water quality at local beaches, harbors and aquatic habitats. City Council authorized subsequent amendments to Revocable Permit No. 26527, extending the current term of the permit to April 15, 2008.
 
The LACDPW has expressed an interest in continuing to utilize the property for the trash removal project; however, the project is now operated by the Los Angeles County Flood Control District (District). The LACDPW, on behalf of the District, has requested a new permit be issued for a period of ten years, commencing April 15, 2008, with the District named as the Permittee.
 
In an effort to accommodate the District and continue the trash removal project, a Revocable Permit (Permit) has been proposed containing the following major terms and conditions:
 
      . Permittee: Los Angeles County Flood Control District.
 
      · Term: The term of the Permit shall be for a period of ten (10) years, commencing
        April 15, 2008.
 
      · Fee: $1.00 per year.
 
      · Termination: Either party may terminate the Permit for any reason upon thirty (30)
        days written notice to the other party.
 
      · Hazardous Materials: No hazardous materials will be brought onto or stored in the
        Permit area.
 
This letter was reviewed by Deputy City Attorney Richard F. Anthony on February 28, 2008, and Budget Management Officer Victoria Bell on March 3, 2008.
 
TIMING CONSIDERATIONS
City Council action is requested on March 18, 2008, in order to facilitate continued operation of the project.
 
FISCAL IMPACT
There is no fiscal impact associated with this recommendation.
