TITLE
Recommendation to authorize City Manager to execute a First Amendment to Joint Use of Facilities Agreement No. 20659 with Long Beach Unified School District for the shared use and maintenance of LBUSD-owned property, commonly known as the Blair Field parking lot, which will suspend the term of the Agreement and will guarantee LBUSD's future use of Blair Field for its high school baseball games for as long as Lease No. 32223, between the City of Long Beach and the Trustees of California State University Long Beach, regarding the operation of Blair Field, is in effect.  (District 3)
 
DISCUSSION
On March 28, 1989, the City Council authorized the sale of City-owned property located adjacent to 4700 Deukmejian Drive, commonly known as the Blair Field parking lot (Parking Lot), to the Long Beach Unified School District (LBUSD).  As a condition of this sale, Joint Use of Facilities Agreement No. 20659 (Agreement), between the City of Long Beach (City) and LBUSD, was established to provide for the City's continued use and shared maintenance of the Parking Lot.  In FY 09, due to budgetary constraints, the Department of Parks, Recreation and Marine was instructed to cut expenditures associated with the use and operation of Blair Field beginning in FY 10, which included researching its potential leasing to a third party.
 
In FY 09, the City began negotiations with the Trustees of California State University Long Beach (CSULB) to enter into a long-term lease for Blair Field, and on August 10, 2010, the City Council authorized Lease No. 32223 (Lease) for this purpose.  Effective September 1, 2010, the City ceased all operations at Blair Field.  Although the Lease is in effect, the Parking Lot remains under the control of LBUSD.  Because CSULB is now the primary operator of Blair Field under the Lease, CSULB shall enter into a joint-use agreement with LBUSD for the use and maintenance of the Parking Lot.  CSULB's joint-use agreement with LBUSD will supersede the City's joint-use agreement with LBUSD, thus requiring a First Amendment to Joint Use of Facilities Agreement No. 20659, which will suspend the term of the City's Agreement for as long as the Lease and CSULB's joint-use agreement with LBUSD are in effect.
 
The Lease also ensures that LBUSD has the ability to play up to 26 baseball games over a period of up to 22 days as a subtenant of the City.  In exchange for consenting to the First Amendment and agreeing to enter into a joint-use agreement with CSULB, LBUSD has requested that its guaranteed future use of Blair Field be added as a provision of the amended Agreement.
 
This matter was reviewed by Deputy City Attorney Richard Anthony on August 4, 2011, and Budget Management Officer Victoria Bell on August 8, 2011.
 
TIMING CONSIDERATIONS
City Council action is requested on August 23, 2011, in order to suspend the term of Joint Use of Facilities Agreement No. 20659 while Lease No. 32223 is in effect, which will enable California State University Long Beach to enter into its own joint-use agreement with Long Beach Unified School District for the use and maintenance of the Blair Field parking lot, and to guarantee LBUSD future use of Blair Field through an added provision to the amended Agreement.
