TITLE
Recommendation to adopt resolution authorizing City Manager to execute a contract with Bayer Corporation for the purchase of diagnostic test kits for one year for the estimated sum of $125,000, with the option to extend the contract for two additional years at the discretion of City Manager.  (Citywide)
 
DISCUSSION
The City's Department of Health and Human Services (DHHS) Public Health Laboratory performs approximately 1,900 HIV-1 viral load tests each year. These tests are conducted as part of the operations of the Sexually Transmitted Disease (STD) Clinic and are a core function of the DHHS to prevent and treat STDs and other communicable diseases. Bayer Corporation produces a viral load assay specifically designed to target multiple sequences on the HIV-1 genome with more than 80 nucleic acid probes. Because the technology used by Bayer Corporation for the HIV-1 testing methodology is proprietary and not available from any other manufacturer, the attached Resolution is necessary to authorize the City Manager to execute a contract without advertising for bids. This matter was reviewed by Senior Deputy City Attorney Donna Gwin on August 22,2005
and Budget Management Officer David Wodynski on August 26,2005.
 
TIMING CONSIDERATIONS
City Council action on this matter is requested on September 6, 2005 to maintain inventory of HIV-1 viral load testing kits.
 
 
FISCAL IMPACT
Purchases not to exceed $125,000 per year are offset by the revenue produced by programs and outside agencies requesting the tests. Sufficient funds are budgeted in the Health Fund (SR130) in the Department of Health and Human Services (HE).
