TITLE
Recommendation to authorize City Manager to execute the First Amendment to the Cooperative Agreement between and among the Gateway Cities Council of Governments (COG), the City of Long Beach (City), and the Port of Long Beach (Port) for the Truck-Impacted Intersection Project located at the intersection of Santa Fe Avenue and Anaheim Street.  The Amendment provides an additional $100,000 in grant funds for the project.  (District 1)
 
DISCUSSION
As part of a program to improve goods movement throughout the Gateway Cities Sub Region, the COG initiated the Truck-Impacted Intersection Project. The program was intended to facilitate truck circulation in the Gateway Cities area through a series of infrastructure and operational improvements at major intersections heavily impacted by trucks. The intersection of Santa Fe Avenue and Anaheim Street in the Harbor area was identified by both the City and the COG as one of the truck-impacted intersections that required improvement.
 
Improvements at the Anaheim/Santa Fe intersection featured reconstruction of the entire intersection, including the approach legs, with the installation of concrete pavement. The original scope of work also included the installation of a traffic signal interconnect and the replacement of pavement striping and markings. Since this roadway is within the Harbor Area, the Port is responsible for the maintenance and repair of this roadway.  Construction was completed by the Port in December 2011.
 
A Cooperative Agreement between the City, the Port, and the COG was approved by City Council on July 7, 2009. That agreement originally estimated the total project cost to be $750,000, and provided for $487,500 (65 percent) in reimbursement funds from the COG to the Port for the design, construction, construction engineering, and inspection, with the remainder of the funding, in the amount of $262,500 (35 percent) being borne by the Port.
 
The First Amendment to the Cooperative Agreement revises the scope of work to include utility work required prior to installation of the new concrete pavement and installation of new inductive traffic loops, increasing the project budget to $903,846 and the amount of reimbursement of Port expenditures by the COG up to $587,500. The remainder of the funding, in the amount of $316,346, is being borne by the Port.  On February 27, 2012, the Board of Harbor Commissioners approved the First Amendment to the original Cooperative Agreement.    
 
This matter was reviewed by Deputy City Attorney Linda Trang on March 14, 2012 and by Budget Management Officer Victoria Bell on March 15, 2012.  
 
TIMING CONSIDERATIONS
City Council action is requested on April 3, 2012, in order to execute the First Amendment to the original Cooperative Agreement.  Project construction concluded in December, 2011, and reimbursement to the Port is contingent upon execution of the First Amendment.
 
FISCAL IMPACT
Under the First Amendment to the Cooperative Agreement, the final project cost is $903,846.  The Amendment provides that the COG reimburse the Port an additional $100,000.  The revised total of reimbursements from COG to the Port is now $587,500.  The original agreement requires the Port to provide matching funds equal to 35 percent of the total project costs.  Per the Amendment, the required matching funds increased by $53,846 to a total of $316,346.  There is no fiscal impact to the General Fund and no known local job impact associated with the recommended action.
