Resolution declaring the results of the Consolidated Primary Nominating Election (consolidated with the Long Beach Unified School District and the Long Beach Community College District) held in the City of Long Beach, California, on Tuesday, April 13, 2004, for the purpose of nominating and/or electing candidates for four (4) offices on the City Council from District Numbers 2, 4, 6 and 8; and directing the City Clerk to place on the ballots to be used at the General Municipal Election to be held on the 8th day of June, 2004, the names of the candidates declared to have been nominated by the Primary Nominating Election; and directing the City Clerk to issue a Certificate of Election to the candidates declared to have been elected at the Primary Nominating Election.
 
DISCUSSION
Pursuant to the Long Beach Municipal Code and the State Election Code, the City Clerk is required to conduct a canvass and certification of the April 13, 2004, Primary Nominating Election, within fourteen days.
 
The canvass process requires that the City Clerk perform these tasks:
 
(a) An inspection of all materials and supplies returned by poll workers.
 
(b) A reconciliation of the number of signatures on the roster with the number of ballots recorded on the ballot statement.
 
(c) In the event of a discrepancy in the reconciliation required by subdivision (b), the number of ballots received from each polling place shall be reconciled with the number of ballots cast, as indicated on the ballot statement.
 
(d) A reconciliation of the number of ballots counted, spoiled, canceled, or invalidated due to identifying marks, over-votes, or as otherwise provided by statute, with the number of votes recorded, including absentee and provisional ballots, by the vote counting system.
 
(e) Processing and counting any valid absentee and provisional ballots not included
 
in the semifinal official canvass.
 
(f) Counting any valid write-in votes.
 
(g) Reproducing any damaged ballots, if necessary.
 
(h) Reporting final results to the governing board and the Secretary of State, as required.
 
(i) Conduct of a 1 percent public manual tally.
 
On April 23, 2004, the City Clerk Department executed the attached City Clerk's Certificate of Canvass affirming compliance with the foregoing requirements. (Attachment A).
 
With completion of the canvass, the City Council is now required to declare elected or nominated to each office voted on the persons having the highest number of votes for each office. The attached resolutions have been prepared by the City Attorney to meet these purposes:
 
1. To declare those elected to Council 2nd, 4th, and 6th Council District Offices and those nominated for the ath Council District Office based on the results of the April 13, 2004 Primary Nominating Election. The Official Statement of Results is attached to Exhibit "A" of the resolution implementing this action. Votes for the qualified 2nd District write-in candidate are shown in the detail reports at the end of Exhibit "A" and are titled by each precinct number in the district.
 
2. To declare those elected to the Long Beach Unified School District and Long Beach Community College District. The Official Statement of Results is attached to Exhibit" A" of the resolution implementing this action.
 
3. To order holding of a General Municipal Election on Tuesday, June a, 2004, to elect those nominated to Councilath District Office.
 
 
IT IS RECOMMENDED THAT THE CITY COUNCIL:
 
Adopt the following resolutions:
 
1. A Resolution of the City Council of the City of Long Beach declaring the results of the Consolidated Primary Nominating Election (consolidated with the Long Beach Unified School District and the Long Beach Community College District) held in the City of Long Beach, California, on Tuesday, April 13, 2004, for the purpose of nominating and/or electing candidates for four (4) offices on the City Council from district numbers 2, 4, 6 and a; and directing the City Clerk to place on the ballots to be used at the General Municipal Election to be held on the ath day of June, 2004, the names of the candidates declared to have been nominated by the Primary Nominating Election; and directing the City Clerk to issue a certificate of election to the candidates declared to have been elected at the Primary Nominating Election.
 
2. A Resolution of the City Council of the City of Long Beach certifying the results of the Consolidated Primary Nominating Election held in the City of Long Beach, California, on Tuesday, April 13, 2004, for the purpose of nominating and/or electing candidates for one (1) office on the Governing Board of the Long Beach Unified School District, and for one (1) office on the Board of Trustees of the Long Beach Community College District,
 
3. A Resolution of the City Council of the City of Long Beach ordering, proclaiming, calling, giving notice of and providing for the holding of a General Municipal Election to be held in the City of Long Beach on Tuesday, the 8th day of June, 2004, for the election of a City Council member from the eighth Council District, for a full term of four (4) years commencing with the third Tuesday of July, 2004; designating the ballot listing of the candidates to be voted on; and adopting provisions relating to the translations of and the charges for costs of candidate statements.
 
SUGGESTED ACTION
Adopt resolution.
 
FISCAL IMPACT
Sufficient funds have been bud~eted to cover the costs of this election in the FY 04 Budget. The election on June a will involve 13 precincts and 10 voting locations. All votes will be transported for central counting at City Hall on Election Day.
