TITLE
Recommendation to authorize City Manager to execute a second amendment to Contract No. 30343 with Nobest Incorporated for the contract for sidewalk repairs, curb ramps, alleys, local and major street concrete repairs, and related improvements increasing the contract amount by $8,000,000.  (Citywide)
 
DISCUSSION
On November 6, 2007, City Council awarded a contract to Nobest Incorporated for the repair of sidewalks, alleys, local and major concrete streets, and related improvements, as well as the installation of curb ramps (Exhibit A). The contract was bid with an estimated quantity of work to be done over the 12-month contract period, and contains contract language that allows the City to adjust these quantities based on need and budgetary considerations.
 
The contract provides for an "on-call" arrangement, whereby the contractor will provide the City with a fixed unit price to repair sidewalks, curbs, gutters, alleys, drive approaches and curb ramps. The City will issue work orders to the contractor for specific locations with assigned work to be completed within a specified period. Upon the successful completion of a given work order, additional work orders will be assigned until available funding sources for this type of work have been depleted.
 
Work orders for sidewalk repairs will consist of block locations identified by the City's current inventory list and confirmed by the individual Council District offices as priority locations. In addition, this contract will include work orders for concrete curb and cross gutter repair done in conjunction with the local street resurfacing program. Based on budgeted amounts in the sidewalk and local street programs, as well as use of this contract by other City Departments, staff is proposing to increase the contract amount by $8,000,000 to cover these anticipated needs. The contract amount includes an anticipated increase of 5% in Nobest's contract charges for 2009.
 
This matter was reviewed by Deputy City Attorney Linda Trang on December 17, 2008 and by Budget Management Officer Victoria Bell on December 17, 2008.
 
TIMING CONSIDERATIONS
City Council action on this matter is requested on January 6, 2009 in order to avoid delays in proceeding with budgeted sidewalk and street repairs.
 
FISCAL IMPACT
Because individual purchase orders issued under this contract will be funded by the department issuing the purchase order within current appropriations, no appropriation increases are required. Projects supported by State transportation funding such as Gasoline Tax or Proposition 42 Traffic Congestion Relief will commence when the funding has been received from the State.
